ADOPTING ORDINANCE
ORDINANCE NO. 17-15
AN ORDINANCE ADOPTING THE OFFICIAL CITY CODE OF THE CITY OF MASON CITY, CERRO GORDO COUNTY, IOWA TO BE KNOWN AS THE "2017 CITY CODE, MASON CITY, IOWA"; PROVIDING FOR THE ADOPTION AND READOPTION OF ALL ORDINANCES OF A GENERAL NATURE AND PROVIDING FOR THE RETENTION OF ALL SPECIAL ORDINANCES AND PROVIDING A SAVING CLAUSE
   BE IT ORDAINED by the City Council of the City of Mason City, Iowa:
   Section 1: The official City Code of Mason City shall be and comprise that certain loose leaf volume published by Sterling Codifiers, Inc., containing thirteen (13) titles and appropriate chapters, articles and sections within the titles published upon order of the City Council and containing all of the general effect ordinances of the City.
   Section 2: The ordinances of a general nature contained in this official City Code shall be deemed to be continuous provisions and not reenactments of the same material on the same subject. Nor shall the repeal of any general ordinance affect or be deemed to cause any special ordinance to have been repealed, but such special ordinances, including but not limited to franchise ordinances, tax levy ordinances, land description ordinances or bonding ordinances shall continue in full force and effect as though no new City Code had been prepared and hereby adopted.
   Section 3: Amendments to the official 2017 City Code, as hereby adopted, shall be made by ordinance amending or repealing a specific title, chapter, article or section of this Code. Such amendments shall refer to the said section to be amended or repealed by section number and such changes, when adopted by the governing body, shall be incorporated into the official Code by replacement pages, properly marked and identified and prepared by Sterling Codifiers, Inc., for insertion in each of the official Code books in existence.
   Section 4: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
   Section 5: If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section thereof, or part thereof, not adjudged invalid or unconstitutional.
   Section 6: This ordinance shall be in full force and effect upon its final passage, approval and publication as required by law.
