(A) Except as provided in division (B) below, a Council member shall hold office for a term of four years and until the qualification of a successor.
(B) (1) At the first annual election held after the organization of a city under this title, the electors of the city shall elect two Council members from each ward, who shall, at the first meeting of the Council, decide by lot their terms of office, with one from each ward to hold for a term of four years and one for a term of two years and until the qualification of their successors.
(2) In the succeeding elections, one Council member from each ward must be elected for a four-year term.

The Council has power to make and pass all bylaws, ordinances, orders and resolutions, not repugnant to the Constitution of the United States or of Montana, necessary for the government or management of the affairs of the city, for the execution of powers vested in the city and for carrying into effect the provisions of the statutes of the state.

(A) The City Council has power to prescribe the duties of all officers of the city, subject to the limitations of the statutes of the state.
(B) The duties of the Street Commissioner, Chief of the Fire Department and other city officers not prescribed by the statutes of the state may be prescribed by ordinance.

When any vacancy occurs in any elective office, the Council, by a majority vote of the members, may fill the same for the unexpired term and until the qualification of the successor. The vacancy in the office of Council member must be filled from the ward in which the vacancy exists; but, if the Council shall fail to fill such vacancy before the time for the next election, the qualified electors of such city or ward may nominate and elect a successor to such office.
