5.16.020   License issuance-Bond required.
   Prior to the issuance of a license as provided in this chapter, the applicant shall file with the city manager a bond payable to the city in the amount of five thousand dollars in such form and with such sureties as shall be approved by the mayor and the city attorney, conditioned upon the applicant's compliance with the requirements of this chapter and all other ordinances of the city which are now or may hereafter be adopted and which are pertinent to such business. Such bond shall be further conditioned upon such applicant's filling all basements left as a result of such moving, leaving all premises vacated by such moving in a safe and sanitary condition, repairing and making good, to the satisfaction of the mayor, any and all damages to any pavement, sidewalk, hydrant, street, alley or other property of the city where damage to which may be caused by the moving of such building, and further conditioned upon the applicant's indemnifying and saving harmless the city against any and all liability for damages, costs or expenses arising in any manner in favor of any person by reason of the moving by applicant of any such building. 5.16.030   Permit required for each structure to be moved- Application-Fee.
   A.   Any person, the owner of any house, building or structure which is intended to be moved upon the streets, alleys or other public ways of the city, shall first apply for and obtain a permit from the building inspector of the city to be approved by the city engineer. Such permit shall be conditioned by the building inspector and city engineer upon the performance by the owner or his agents with such reasonable requirements as may be deemed necessary for the protection of the property of the city and its inhabitants. Such application for a permit shall show, in connection with the house, building or structure to be moved, its construction at the present time, its present use and location, its new location together with a diagram of the lot showing the existence of other buildings thereon and the substructure upon which it is intended to be placed, its intended use for the future at such new location, the route to be traversed in the moving thereof, the length of time required for such moving, and the name of a properly licensed person contracting to move such structure.
   B.   A permit fee of twenty-five dollars shall be charged for each building, house or structure to be so moved, for each seventy-two hours or portion thereof that such structure shall remain standing upon any public street or way in the city. (Prior code § 14-3-3)
5.16.040   Permit-Issuance restrictions.
   No permit shall be issued for the moving of any house, building or structure in the event that the moving or placing of such structure at its new location will in any manner violate the city building code or other pertinent city ordinances and such permit shall not be issued if the placing of such structure at its new location will violate the provisions of the contractual building restrictions existing in the subdivision or area to which such structure shall be moved. 5.16.050   Liability for damages.
   Any person issued a license and a permit under the provisions of this chapter shall be responsible and liable to the city for any damage or injury caused to its property by the moving of such structure. The failure of any such person to adjust any damage to the city or to any of the inhabitants of the city shall result in the vesting in the proper city authorities the right to cancel any outstanding licenses to such person together with the right to refuse the issuance of any future license to such person together with authority to deny the issuance of a permit to any person for the moving of any structure when such contemplated moving is to be done by a party failing to comply with the provisions of this chapter. 5.16.060   Injury to utility poles or trees.
   Nothing in any license or permit granted under this chapter shall be construed as authorizing the holder thereof to break, injure or remove any telegraph, telephone or electric light poles, lines or wires or in any way injure shade trees or other property of any owner or owners thereof. 5.16.070   Structures on public ways in excess of seventy-two hours.
   No house, building or structure being moved under authority of the provisions of this chapter shall be allowed to stand upon any public street, alley or way of the city for more than seventy-two hours consecutively unless the owner shall pay an additional fee of twenty-five dollars as provided by Section 5.16.030.
