Every insurance company subject to the license fees imposed by this chapter shall on or before March 31 of each calendar year furnish the Metro Revenue Commission with a written itemization of all premiums collected for which a license fee is payable together with the amount of such license fee collected and paid in the preceding calendar year for the following kinds of insurance:
(A) Casualty;
(B) Automobile;
(C) Inland marine;
(D) Fire and allied perils; and
(E) Life.

Every insurance company subject to the license fees imposed by this chapter shall maintain records adequate to support the reports required to be filed under this chapter. Authority is given to the Metro Revenue Commission to make or cause to be made through any of its officers or employees personal inspection of the books, accounts, and records of the agent or agency of any such insurance company, corporation, firm, association, exchange, or concern in the Louisville Metro Government to verify the correctness of any sworn statement or return required to be filed as herein provided.

This section applies to insurance agents and surplus lines brokers to the extent they are responsible for collection and payment of license fees pursuant to KRS 91A.080.

A claim for refund of any license fees paid pursuant to this chapter or under § 38.64 must be filed within two years of the due date or the date the license fee was paid, whichever is later.

If any provision of this chapter as now or later amended or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions that can be given effect without the invalid provision or application.

Pursuant to KRS 91A.080, willful failure to properly collect and remit the license fees imposed by this chapter may constitute grounds for the revocation of the license issued to an insurance company or agent under the provisions of KRS Chapter 304 or may result in other penalties being imposed by the State Office of Insurance.
