Sec. 19.21. Procedure and Penalties. (Charter Section 217)
 
   (a)   The Chief of Police shall cause all subpoenas issued by the City Clerk to be served. Provided, however, that with respect to matters over which it has jurisdiction, the City Ethics Commission is authorized to issue subpoenas and have them served by the staff of the Commission.
 
   (b)   Any person who fails or refuses without lawful excuse to attend any proceeding, or to produce material evidence in the person’s possession or under the person’s control as required by any subpoena served upon that person pursuant to Subsection (a), or who being present at any proceeding either in obedience to a subpoena or otherwise, willfully refuses to be sworn or answer any material or proper question when directed to do so, shall be guilty of a misdemeanor punishable by a fine of not more than $1,000.00 or by imprisonment in the County Jail for not more than six months, or by both fine and imprisonment.
