Sec. 70.1.
Notwithstanding the provision contained in Section 70 that the Department of Pensions shall “be under the control and management of a board of five commissioners,” the Board of Pension Commissioners, from and after the effective date of this section or as soon thereafter as shall be practicable, shall consist of seven members. Five members thereof, as provided by Article VI, shall be appointed by the Mayor subject to the approval of the Council. Two members thereof, one of whom shall be a member of the Fire Department as defined in Section 185 or Subsection (e) of Section 190.02 and one of whom shall be a member of the Police Department as defined in Section 185 or Subsection (f) of Section 190.02, each shall be elected by the members of his department, as so defined, for such terms of office and in such manner as the Council, by ordinance, shall determine. It shall be mandatory upon the Council to adopt an ordinance, as soon as shall be practicable after the effective date of this section, which shall fix the terms of office of the two employee-members of said board and set forth a comprehensive procedure for the election of the first two of such members and of their successors in office. (Added, 1971.)
No retired member of either of the aforementioned departments shall serve as an appointed or elected member of said board. (Added, 1971.)
The provisions of Article VI hereafter shall be construed and applied in accordance with the provisions of this section. (Added, 1971.)
