§ 31.05 ADVISORY PLANNING COMMISSION.
   (A)   Establishment. There is hereby created and established a City of Linton Planning Commission, which has all of the powers and duties authorized under the laws of the state of Indiana, including those set forth in I.C. 36-7-4 et seq., and the members of the Commission are charged with all of the duties and responsibilities set forth under the laws of the state of Indiana.
   (B)   Membership. The membership of the City of Linton Advisory Planning Commission shall be in accordance with the laws of the state. The official members are hereby designated to be: three members to be appointed by the Common Council from person in the city government, the term of such appointed members to be coexistent with the term of office for which he or she has been elected or appointed; and four citizen members to be appointed by the Mayor, no more than two of whom shall be of the same political party. Two of the citizen members shall be appointed for a term of three years to expire on the first Monday of January of the third year after their appointment; and the remaining two shall be appointed for a term of four years to expire the first Monday of January on the fourth year following their appointment. Thereafter, as terms expire, each new appointment shall be for a term of four years.
   (C)   Election of officers, powers and duties. It shall be the duty of the City Planning Commission to organize ad elect one of its members as Chairperson, one of its members as Vice-Chairperson and one of its members as Secretary. The City Planning Commission shall hold hearings for the purpose of recommending to the Common Council the adoption of ordinances regulating the use of land, sanitary and safety standards, building and safety standards, fire prevention and safety standards, and all other uses of land that affect the health, safety, and welfare of citizens. This authority shall not be construed as a limitation on the City Planning Commission, but the Planning Commission shall have authority to make recommendations as may be authorized by the laws of the state.
   (D)   Meetings. It shall be the duty of the City Planning Commission to hold regular meetings, keeping regular minutes of those meetings in accordance with the laws of the state of Indiana.
   (E)   Extraterritorial authority. By the laws of the state of Indiana, the City of Linton, through its City of Linton Advisory Planning Commission, ad the City Planning Commission, hereby exercise their extraterritorial authority two miles outside the contiguous boundaries of the city.
   (F)   Quorum. Four members of the City of Linton Planning Commission shall constitute quorum to do business.
