Sec. 15.05. - Extra Compensation.
Due to the unusual nature of the tasks facing the first Mayor and the members of the first Council of the Lexington-Fayette Urban County Government during the transitional period between their election and the effective date of this Charter, said officers shall be entitled to receive the following compensation during said transitional period:
A.   Mayor—A sum of Twenty-Five Dollars ($25.00) per day, excluding Saturdays, Sundays and holidays beginning on November 7, 1973 and ending December 31, 1973.
B.   Members of the Council—A sum of Five Dollars ($5.00) per day, excluding Saturdays, Sundays and holidays beginning on November 7, 1973 and ending December 31, 1973.
Said transitional per diem compensations are to be paid to each officer in two (2) installments, one on or before the thirtieth day of November and the second on or before the thirty-first day of December, 1973, by the City of Lexington and the County of Fayette in accordance with the following formula:
A.   The County of Fayette shall be responsible for that portion of said compensations equal to its percentage of the total expenditures of the City and County for the most recent fiscal year ending on or before July 1, 1973; and
B.   The City of Lexington shall be responsible for that portion of said compensations equal to its percentage of the total expenditures of the City and County for the most recent fiscal year ending on or before July 1, 1973.
No officer or employee of the City of Lexington or the County of Fayette elected under the provisions of Section 15.02 of this Charter shall be entitled to the aforementioned compensation unless he or she shall have resigned or otherwise severed all connections with said City or County governments on or before the date of their election as officers of the Lexington-Fayette Urban County Government. Otherwise said officers and employees shall continue to be eligible for such compensation as they may be entitled to under law, ordinance or resolution governing their respective office or position in the government of the City of Lexington or the County of Fayette until such time as they assume office as officers of the Urban County Government under the terms of this Charter.
Annotation—Sections 15.05 and 15.06—The provision for compensation for the mayor and council members after their initial election and before the beginning of their terms of office (November and December, 1973) was held invalid. Holsclaw v. Stephens, supra, at 480-481.
