Following the election of the first Mayor and the members of the first Council under this Charter, all officers and employees of the City of Lexington, the County of Fayette, and all boards, commissions and authorities thereof shall assist and cooperate in the planning and scheduling of the implementation of this Charter. To that end, the officers and employees of said governments and all boards, commissions and authorities thereof shall:
A. Provide, to the extent possible, such office space, equipment and secretarial assistance as may be required by the first Mayor and the members of the first Council during the aforementioned transitional period;
B. Allow the first Mayor and the members of the first Council to examine all files, records and other data in the possession of said governments, boards, commissions and authorities during said transitional period; and
C. Appropriate sufficient funds to cover the anticipated costs of compensating and otherwise assisting the first Mayor and the members of the first Council of the Lexington-Fayette Urban County Government in accordance with the provisions of this Charter pertaining to the transitional period between the election of said officers and the effective date of this Charter.
Failure to comply with the provisions of this Section shall constitute an official breach of the spirit and intent of KRS 67A, as amended. Any officer or employee of the City of Lexington and/or the County of Fayette, their departments, boards, commissions, authorities or agencies contributing to such non-compliance shall be subject to the charge of malfeasance under appropriate law, ordinance or resolution.
