(A) The city hereby establishes the nonelective office of Fire Chief.
(B) The Fire Chief shall be a resident of Grayson County.
(C) In the event of a vacancy, the members of the Fire Department may present the name of a member of the Department to the Mayor of the city who may present the name to the City Council as a nominee of the Department as Fire Chief, in which event, no other name shall be placed in nomination until and unless such nomination be rejected by the Council.
(D) Responsibilities and duties.
(1) The Fire Chief shall have supreme command over the Fire Department while fighting fires and shall call upon all other departments of the city government for aid and assistance in the preservation of life and property.
(2) The Fire Chief shall be responsible for the maintenance and repair of all Fire Department property and equipment; he shall, by order, provide for responsibility by the members for maintenance and repair of equipment in their possession.
(3) The Fire Chief, while engaged in the command of his Department within the corporate limits of the city, when it may be necessary for the protection of other property and to prevent the spread of a conflagration, may cause buildings to be removed, torn down or destroyed in the best manner possible.
(4) The Fire Chief, in addition to statutory duties placed upon him, shall perform such other duties relative to fire prevention and fighting as may be delegated to him from time to time by the City Council by ordinance.
(E) The Fire Chief may resign by notifying the members of the Fire Department and calling for an election of a nominee, and upon election, presenting his resignation to the City Council together with the results of the election.
(F) The Fire Chief shall be paid compensation at an amount set by executive authority and legislative body.
(G) The Fire Chief shall not be required to take an oath or execute a bond.

Each nominee for membership in the Fire Department shall submit to a physical examination, prior to being accepted in to the Department, to be performed by a medical doctor chosen by the Fire Chief. Each member's name, address, social security number, age and copy of his application for membership shall be given to the City Clerk/Treasurer, and such member shall be carried as an active member until certification is received by the Clerk/Treasurer from the Department that said member is no longer active; no person shall be considered a member until such information be received by the Clerk/Treasurer, provided further that members of the Department as of the effective date of this chapter are not required to submit applications.

Each member of the Fire Department shall immediately provide the City Clerk/Treasurer with the name and relationship of each spouse, child or parent who is dependent upon the member for support, and shall immediately notify the Clerk/Treasurer of any change in such dependency.

The members shall provide for such other officers as are required by the Fire Department's need and shall elect or select such members from the ranks of the Department to fill the positions created by the Department; nothing in this section shall affect the command of the Fire Chief over the Department in the exercise of its primary duties.

The Fire Department shall engage in fighting fires within the corporate limits of the city and such other places as directed by the Fire Chief or as emergency dictates; the Department shall engage in training under its Chief or officers to keep it at its present level of effectiveness or for its improvement; the Department may engage in activities conducive to fire prevention and detection and such other activities of a civic and characterable nature.
