§ 97.080 CONCRETE CONSTRUCTION; COMPLIANCE.
   All sidewalks hereafter constructed within the city, upon any street, alley or part thereof, unless otherwise specifically provided by law, shall be constructed of concrete of the best material, according to the specifications hereinafter provided.

§ 97.081 LOCATION OF SIDEWALK PROVIDED BY ORDINANCE.
   The city, before any such sidewalk shall be constructed, shall provide by a special ordinance for the location of same. Such ordinance shall define the location and grade of such proposed sidewalk with reasonable certainty, shall prescribe its width, and shall provide that the material of which it shall be constructed, and the manner of its construction, be as provided in this chapter, by incorporating therein this subchapter by reference hereto, and when so incorporated this subchapter shall be as much a part of said ordinance as if its terms had been fully set down therein by express recital, and said materials and such construction shall be under the supervision of and subject to the approval of the City Engineer.

§ 97.082 COST APPORTIONED.
   Fifty percent of the cost of the construction of any sidewalk upon any street, alley or part thereof in the city shall be paid for by special taxation of the lot, lots, parcel or parcels of land touching upon the line where such work shall be constructed in proportion to their frontage upon such walk, and the residue of such cost shall be paid out of any fund of the city raised by general taxation; except where said sidewalk construction is a public improvement recommended by the Board of Local Improvements and provided for by an ordinance duly passed by the City Council, then in that event the said construction is to be paid for in the manner provided for in the said ordinance.

§ 97.083 OWNER MAY BUILD SIDEWALKS.
   (A)   The owner or owners of any lot, lots, parcel or parcels of land touching the line of any sidewalk which may be ordered by said city to be constructed, are hereby required to construct a sidewalk in front of their respective lots or parcels of land, in accordance with the specifications of this subchapter and the ordinance ordering the construction thereof within 30 days after the mailing of notice of the passage of said special ordinance, addressed to the party who paid the last general taxes on the respective lots or parcels of said land.
   (B)   Notice of the intention of the owner to construct such sidewalk shall be given in writing to said City Engineer at least ten days prior to the commencement of the work of constructing the same in order that the City Engineer may have opportunity to examine said materials for the purpose of ascertaining whether they are of the kind and quality required by this chapter.

§ 97.084 NOTICE TO ENGINEER.
   In case of the default of the owner or owners of any lot, lots, parcel or parcels of land, as required by the provisions and specifications of this subchapter and the special ordinance requiring such construction, the city may furnish the materials and construct said sidewalk in accordance with this subchapter and said special ordinance, or may enter into a contract for the furnishing of said materials and the construction of said sidewalk is hereinafter provided, and 50% of the total cost of the construction of said sidewalk in front of any lot or lots or parcels of land, including supervision, shall be charged against said lot, lots or parcels of land as a special tax in proportion to the frontage of said lot, lots or parcels upon such walk, and may be collected as hereinafter provided; and it shall be lawful for the city to issue noninterest bearing vouchers in payment for such walks, payable solely out of the special tax as herein provided for when the same is collected.

§ 97.085 ENGINEER TO PREPARE TAX LIST.
   It shall be the duty of the City Engineer to make a bill of costs of such sidewalk, showing the cost of construction and supervision thereof, together with a list of the lots or parcels of land touching upon the line of said sidewalks, the names of the parties who paid the last general taxes on the respective lots or parcels upon said sidewalks. Said City Engineer shall proceed to prepare a special tax list against such lots, blocks, tracts or parcels in front of or touching, upon which said sidewalk has not been constructed, ascertaining by computation the amount of special taxes to be charged against each of said lots, blocks, tracts or parcels of land on account of the construction of said sidewalk, according to the rule fixed for the levy of such special taxation by this chapter, which special tax list shall be filed in the office of the City Clerk and he shall thereupon issue warrants directed to the Clerk (he being hereby designated as the owner who shall collect said tax), for the collection of the amount of special tax so ascertained and appearing from said special tax listed be due from the respective lots, blocks, tracts or parcels of land touching upon the line of said sidewalk, and the Clerk shall proceed to collect the warrants by giving notice in writing by mailing same to address of party who paid the last general taxes on the respective lots, blocks, tracts or parcels of land in said list, that same tax list is in the hands of said Clerk for collection. All money so collected by him shall by him be immediately paid over to the City Treasurer, whose receipt he shall take therefor as his voucher or said payments.

§ 97.086 DELINQUENT TAX LIST TO COUNTY TREASURER.
   Upon the failure to collect such special tax as heretofore provided, it shall be the duty of the City Clerk on or before April 1, in each year, to make report of all such special tax in writing to the County Treasurer, of all the lots and parcels of land upon which such special tax shall be so unpaid, with the names of the respective owners thereof, so far as the same are known to said Clerk, and the amount due and unpaid upon each tract, together with a copy of the ordinance ordering the construction of said sidewalk, which report shall be accompanied by oath of the Clerk that the list is a correct return of the lots and parcels of land on which the special tax levied by authority of said city for the partial cost of the sidewalk in said ordinance specified remains due and unpaid, and that the amounts therein stated are due and unpaid, have not been collected, or any part thereof.
