(a) Definitions. Unless the context otherwise requires, the following words or phrases shall be construed according to the definitions set forth below:
(1) "Pedal cycle" means a vehicle propelled solely by human-powered pedals.
(2) "Traffic way" means the entire width between property lines, or other boundary lines, of every way or place, any part of which are open to the public for purposes of vehicular travel as a matter of right or custom.
(b) Violations.
(1) No person shall ride upon or utilize in any manner upon the streets or sidewalks in the City any skateboard, roller skates, scooter or any other human-powered device, other than a pedal cycle.
(2) Any person riding upon or utilizing any skateboard, roller skates, scooter or any other human-powered device, other than a pedal cycle, in an alley, playground or any other place open to pedestrian traffic not prohibited by this section, shall yield right of way to any pedestrian and shall utilize such device with all due regard to the safety of pedestrians and property.
(3) No person shall erect or place any type of ramp, designed for use with skateboards, roller skates, scooters, pedal cycles or any other human-powered vehicles, onto the streets, alleys, sidewalks and traffic ways in the City.
(4) Repeated violations of this section, or refusal to comply, shall be cause for seizure of the device or devices being used in violation of this section.
(5) No person shall ride upon or utilize in any manner upon playgrounds in the City any skateboard, roller skates, roller blades, scooter, pedal cycle or any other human powered device unless so designated.
(c) Enforcement. It shall be the duty of the Johnstown Police Department to enforce the provisions of this section.

Parades, processions, assemblages or meetings occupying, marching or assembling upon any street, lane, alley or public square of the City are hereby prohibited, unless written notice of the character, time, place and route of such parade or procession, and the names of the officers of the same, are given by the chief officer thereof to the City Manager, or, in the case of assemblages or meetings, unless twenty-four hours notice of the object, time and place of such assemblage or meeting is given to the City Manager by the persons making application for the permit as hereinafter provided.
In pursuance of the aforesaid requirements and for the purpose of preventing interference with and obstruction of the lawful use of streets, lanes, alleys or public squares of the City, and for the preservation of peace and good order, the City Manager may designate, by permit, the time and place of an assemblage or meeting, and in the case of a parade or procession, how much of the streets, lanes, alleys or public squares it will occupy and the time of starting. The length of time of such parade or procession shall be determined by the City Manager, and, when so designated and approved, the proper officers of such parade or procession shall be held responsible for the violation of any designation or limitation mentioned in such permit.

No utility company in the City shall use any street in the City, by its servants, agents, workers and employees or independent contractors, in a metered or unmetered area, for the purpose of making repairs, excavations or construction or reconstruction of facilities, which activities would impede and interfere with the usual and customary flow of traffic, without first obtaining a permit therefor. The fee for such permit shall be established by ordinance of City Council and amended from time to time. The fee shall be for the use of all City-owned streets.

No person, whose vehicle has had a mechanical failure so that it can no longer proceed under its own motive power, in the line of any public street, alley or other public way in the City, shall fail to have the same removed within not more than three hours from the time of such break-down, unless the same occurs at night, in which case he or she shall cause red or amber warning lights to be placed on or around the vehicle so as to prevent accidents by persons driving or otherwise passing along the street, alley or other public way and, further, shall cause the removal of the vehicle before 9:00 a.m. of the following day.

Whoever violates any of the provisions of Section 440.01 shall be fined twenty-five dollars ($25.00) for the first offense, fifty dollars ($50.00) for the second offense, seventy-five dollars ($75.00) for the third offense, and one hundred dollars ($100.00) for each subsequent offense.

Whoever violates any of the provisions of Section 440.11 shall be fined twenty-five dollars ($25.00) for the first and second offense and one hundred dollars ($100.00) for a third and subsequent offense.
