705.99 PENALTY.
   (a)    Whoever violates Section 705.01, 705.02, 705.04 or 705.07 shall be fined not more than five hundred dollars ($500.00).

   (b)    Any person, corporation or firm violating the provisions of Section 705.05, or participating in the violation of its provisions shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each separate dumping, depositing or storage of garbage, rubbish, refuse, litter or other waste material or fill of any kind in violation of such section.

   (c)    Whoever violates any provision of Section 705.03 is guilty of a misdemeanor of the second degree.

   (d)    Any person, firm or corporation found to be operating a retail establishment in violation of Section 705.06 shall, upon conviction, be fined:
      (1)    For the first offense within any twelve consecutive months, based on date of occurrence and not date of conviction, a fine of not less than five hundred dollars ($500.00) nor more than one thousand dollars ($1,000), and no amount of such fine below five hundred dollars ($500.00) may be suspended;
      (2)    For a second or subsequent offense within any twelve consecutive months, based on date of occurrence and not date of conviction, a fine of not less than one thousand dollars ($1,000) nor more than five thousand dollars ($5,000) and no amount of such fine below one thousand dollars ($1,000) may be suspended.
