705.02 GASES AND ODORS FROM BUSINESSES AND INDUSTRIES.

   (a)    Any person, firm or corporation owning or operating a business, manufacturing plant, industrial plant and/or refining and purifying plant in the Municipality, shall, at all times, operate such business, manufacturing plant, industrial plant and/or refining or purifying plant so that no fumes, gases, odors or other volatile substances escape therefrom.

   (b)    The operation and maintenance of any business, manufacturing plant, industrial plant and/or refining or purifying plant from which fumes, gases, odors or other volatile substances are permitted to escape is hereby declared to be a nuisance and to operate the same shall constitute a misdemeanor. The person, firm or corporation owning or operating such business, manufacturing plant, industrial plant and/or refining or purifying plant, from which such fumes, gases, odors or other volatile substances escape, shall be deemed guilty of a misdemeanor.

   (c)    Each day any business, manufacturing plant, industrial plant and/or refining or purifying plant permits fumes, gases, odors or other volatile substances to escape, shall constitute a separate offense.
