705.06 SECURITY GUARD REQUIRED AT RETAIL BUSINESSES DURING NIGHT HOURS.
   (a)    No business establishment providing services or products to the general public in such fashion that members of the public are required to come on the premises to purchase such products or receive such services shall remain open for business at any time between the hours of 1:00 a.m. and 6:00 a.m. on any day if three or more employees are on duty at the premises except, unless and until there shall be on duty on the payroll of the owner or operator of the premises, a security guard, who shall be a sworn police officer, otherwise employed by a governmental entity of the State of Ohio and who shall be armed at all times while on such special duty.
   (b)    Any law enforcement officer of the City finding a violation of this section to apparently exist, shall immediately notify the person in charge of such premises to cease operations until compliance with this section is achieved.
