   1306.01 TITLE.
   This Part Thirteen - Building Code, and all chapters therein, shall be known and may be cited as "The Building Code of the Village of Highland Hills, Ohio."

   1306.02 PURPOSE.
   Within the scope of this Part Thirteen - Building Code, the purpose of this Building Code is to provide minimum standards to safeguard life or limb, health, property and the public welfare.

   1306.03 SCOPE.
   (a)   The provisions of this Building Code, as the same may be from time to time amended or supplemented, shall apply to the location, design, materials, construction, alteration, repair, equipment, use, occupancy, maintenance, removal and demolition of all types of buildings and structures, and appurtenant structures to the extent now or hereafter provided for herein.
   (b)   The provisions of this Code shall not apply to work primarily in a public way, or to public utility towers and poles, mechanical equipment and structures not specifically regulated in this Code including structures and/or buildings owned by the Village of Highland Hills.

   1306.04 SUPPLEMENT TO OTHER LAWS OR ORDINANCES.
   The provisions of this Building Code shall supplement any and all laws of the State of Ohio, ordinances of this Village, or any and all rules and regulations promulgated by authority, of such law or ordinance applicable to buildings and other structures.

   1306.05 INTERPRETATION UPON CONFLICT.
   If in any specific case there is a difference in the materials, methods of construction or other requirements specified in different titles, chapters or sections of this Building Code, or between the requirements of this Building Code and any other applicable law or ordinance, the more restrictive shall govern.    1306.06 ZONING.
   It is not the intent of this Building Code to modify the restrictions of any zoning ordinance or 1aw or any other ordinance or law relating to the use of land. Such zoning restrictions, or other law or ordinance, shall control, except where the provisions of this Building Code are more restrictive, in which case the provisions of this Building Code shall control.

   1306.07 SEVERABILITY.
   Each section of this Building Code, and each part of such section, are declared to be independent sections and parts of sections and, notwithstanding any other evidence of legislative intent, it is declared to be the controlling legislative intent that if any provision of such sections, or the application thereof to any person or circumstance, is held invalid for any reason, the remaining sections or parts of sections and the application of such provision to any person or circumstance other than those as to which it is held invalid, shall not be affected thereby, and it is declared that this Building Code would have been passed independently of such section, sections or parts of a section so held to be invalid.

   1306.08 ADMINISTRATION OF BUILDING CODE.
   The Building Code shall be administered by the Chief Building Official (CBO) and/or his/her designee which may include the Building Administrator and such assistant inspectors as may from time to time be authorized and appointed according to the Charter and ordinances of the Village. Whenever this Code refers to the CBO as being authorized to take certain action, said reference shall also include the CBO's authorized representative.
