5-2-1: DEFINITIONS:
As used in this chapter, the following definitions apply unless specified otherwise:
ANIMAL CONTROL OFFICER: Any duly appointed and qualified city animal control officer, as well as any sworn city police officer.
ATTITUDE OF ATTACK: Behavior of a dog that leads a reasonable person to believe the dog is going to inflict injury upon the person or another, which behavior may include growling, barking, baring of teeth, tense or stiff posture, raised hackles, lunging, or nipping.
BEE: Any stage Apis mellifera and all European subspecies.
BITE: Any abrasion, scratch, puncture, laceration, bruise, tear or piercing of the skin caused by the teeth of an animal.
COMMUNITY CAT: An unowned, outdoor cat. A community cat is not to be classified as a Public Nuisance Animal merely for being repeatedly found unconfined and roaming.
COMMUNITY CAT CAREGIVER: A person who, in accordance with Trap-Neuter-Return, provides care including food, shelter, or medical care to a community cat. A community cat caregiver shall not be considered the owner, harborer, controller, or keeper of a community cat.
CONTINUOUSLY: Any noise that is repeated with less than one (1) minute of silence between the noises.
EARTIPPING: The removal of the half inch tip of a community cat's left-ear, performed while the cat is under anesthesia, to identify the community cat as being sterilized and lawfully vaccinated for rabies at time of surgery.
ENCLOSURE: Any confined space closed on all sides to prevent escape and provide protection from the elements, including a vehicle, pen, cage, or kennel.
FERAL CAT: A cat which is known to live in a wild or semi- wild state without benefit of an owner or a cat which has escaped for a substantial period of time from the care of its owner and is existing in a wild state without benefit of domestication.
HIVE: A receptacle, container, or part of a container, natural or artificial, used as a domicile for bees that is clearly recognized for that use.
HOBBYIST APIARY SITE: An apiary site registered by a hobbyist beekeeper.
HOBBYIST BEEKEEPER: A person who owns a total of no more than two (2) hives.
LIVESTOCK: Cattle, goats, horses, pigs, sheep, and other domesticated animals normally used or raised on a farm.
OWNER: A person over the age of eighteen (18) who owns, keeps, or harbors an animal. A person listed on a dog license, multiple animal license, or dangerous dog license is presumed to be an owner.
RESCUE GROUP: A non-profit entity which is appropriately licensed and regulated, and has at least one of its purposes of the rescue and placement of cats which cannot be kept or placed by public animal control agencies or humane shelters.
RESPONSIBLE PERSON: A person over the age of eighteen (18) who possesses an animal or the parent or guardian of a person under the age of eighteen (18) who possesses an animal, irrespective of whether the person is an owner.
SEVERE INJURY: Any physical injury consisting of a broken bone, muscle tear, disfiguring laceration, or more than one (1) bite or deep puncture. (Ord. 3282, 7-13-2020)
TRAP-NEUTER-RETURN (TNR): The effective process of humanely trapping community cats, and sterilizing, vaccinating for rabies and Feline Viral Rhinotracheitis, Calcivirus, and Panleukopenia, ear tipping, and returning community cats to their original location.
