In their interpretation and application, the provisions of this chapter shall be held to be requirements adopted for the promotion of the health, safety and welfare of the general public. Whenever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, the more restrictive or that imposing the higher standards shall govern. It shall be unlawful to install or operate any well in violation of this chapter. A violation of any provision of this chapter may be treated as a municipal infraction punishable by a civil penalty of not more than three hundred dollars ($300.00) for each violation, or if the infraction is a repeat violation, not to exceed five hundred dollars ($500.00) for each subsequent violation, and other alternative relief from the court as provided by law. Each day the infraction exists constitutes a separate violation. (Ord. 2897, 8-14-2000)
