3-11-9: MARKING:
The issuance of a water well permit shall be conditioned on marking the water well in a manner to be designated by the building official for the purposes of identification, location, and for inspection at such times as may be reasonably required. (Ord. 2897, 8-14-2000)
3-11-10: ADMINISTRATION:
The building and safety division of the community development department is hereby designated and charged with the duty of administering and enforcing the regulations herein prescribed. (Ord. 2897, 8-14-2000)
3-11-11: INTERPRETATION, CONFLICT WITH OTHER LAWS:
In their interpretation and application, the provisions of this chapter shall be held to be requirements adopted for the promotion of the health, safety and welfare of the general public. Whenever the requirements of this chapter are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, the more restrictive or that imposing the higher standards shall govern. 3-11-12: VALIDITY:
Should any section, clause or provision of this chapter be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this chapter as a whole, or any part thereof other than the part so declared to be invalid. (Ord. 2897, 8-14-2000)
3-11-13: VIOLATIONS AND CIVIL PENALTIES:
It shall be unlawful to install or operate any well in violation of this chapter. A violation of any provision of this chapter may be treated as a municipal infraction punishable by a civil penalty of not more than three hundred dollars ($300.00) for each violation, or if the infraction is a repeat violation, not to exceed five hundred dollars ($500.00) for each subsequent violation, and other alternative relief from the court as provided by law. Each day the infraction exists constitutes a separate violation. (Ord. 2897, 8-14-2000)
