937.01 RATES ESTABLISHED.
   (a)   Water Rates.
      (1)   Effective on the August 1, 2013 bill the Village water rate for users inside of the municipality shall be $6.25 per 1000 gallons.
      (2)   Effective on the August 1, 2013 bill the Village water rate for users outside of the municipality shall be $12.50 per 1000 gallons.

   (b)   Water Reclamation Rates.
      (1)   Effective on the August 1, 2013 bill the Village water reclamation rate for users inside the municipality shall be $11.10 per 1000 gallons, with a minimum of $22.20 for 2,000 gallons or less.
      (2)   Effective on the August 1, 2013, bill the Village water reclamation rate for users outside of the municipality shall be $22.20 per 1000 gallons, with a minimum of $44.40 for 2,000 gallons or less.

937.02 BASIS OF SEWER RATES.
   (a)   Designation of Funds for Deposit.   The funds received from the collection of the sewer rates and charges shall be deposited as received with the Fiscal Officer, who shall keep the same in a separate fund designated “Sewer Revenue Fund”. Subject to the provisions of any ordinance or indenture of mortgage authorizing the issuance of and securing mortgage revenue bonds for the system, moneys in said Fund shall be used for the payment of the cost and expense of operation, maintenance, repair and management of the system and any surplus in said Fund over and above the requirements hereinbefore mentioned may be used for payment of debt charges on bonds issued for construction of the system or for extensions and improvements thereto, or notes issued in anticipation of such bonds, and for the payment of the participation charges pursuant to any agreement with the Ohio Water Development Authority, and any surplus in said Fund over and above the requirements hereinbefore mentioned may be used for enlargements of, and replacements to, the system and parts thereof.
   (b)   Basis for Rates. For the purposes provided in subsection (a) hereof, there is hereby levied and charged upon each lot, parcel of land or premises having a connection with the system, or otherwise discharging waste, industrial wastes, water or other liquids, either directly or indirectly into the system, sewer charges payable as hereinafter provided and in amounts to be determined as follows:
      (1)   Except as hereinafter otherwise provided, sewer charges at the rates provided in Section 937.01 with respect to any users shall be based upon the water consumption on said premises for the billing period applicable to said premises. “Water consumption” means the amount of water consumed upon such premises, whether from the municipal system or otherwise, including private sources, during the applicable sewer charge billing period. as measured by a water meter acceptable to the Village Administrator, or if the Village Administrator determines that measurement by water meter is not feasible, then in such manner of measurement of the actual waste water usage as shall be determined by the Village Administrator.
      (2)   The charges in Section 937.01 are current charges and to insure that the appropriate users are providing their equitable share of the revenue needed to sustain the water works an annual audit of the sewer revenue fund shall be determined by the Village Administrator. The Village is obligated to adjust the rates periodically to provide sufficient income to pay all operation and maintenance expenses, and debt service charges on any outstanding bonds.
   (c)   Monthly Billing. Charge for services furnished to all users of the system shall be rendered and collected monthly as provided herein by the Village Administrator on the same bill and at the same time as charges for water service and payment of the water charge may not be accepted without payment of the sewer charge.
   (d)   Penalties for Failure to Pay. All sewer charges shall be payable within fifteen days after billing. In every case of failure to pay all bill for sewer charges when due, a penalty of 10% of such charges shall be added to and collected as a part of such bill.
   (e)   Lien on Premises. Each sewer charge levied pursuant to this section is hereby make a lien upon the premises charged therewith, and if the same is not paid within thirty days after it shall be due and payable, it may be certified to the Auditor of Licking County, who shall place the same on the tax duplicate, with the interest and penalties allowed by law and be collected as other municipal taxes are collected.
   (f)   Prohibition: Unacceptable Wastes. The discharge of unacceptable industrial wastes, as hereinbefore defined, into the system, whether directly or indirectly, is hereby prohibited. Where investigation reveals the presence in the system of unacceptable industrial wastes emanating from any lot, land, building or premises, located within or without the corporate limits of the Village, the owner, lessor, lessee or occupant of said lot, land, building or premises, shall be required to treat, neutralize or in other ways prepare the noxious substance therein, to the satisfaction of the Village Administrator, in order to convert the same into acceptable industrial wastes.
   (g)   Authority of Village Administrator to Make Rules and Regulations. The Village Administrator shall make and enforce such rules and regulations as the Village Administrator may deem necessary for the enforcement of the provisions hereof, for the proper determination and collection of the rates and charges herein provided, and for the safe, efficient and economical management of the system; and such rules and regulations, when not repugnant to existing ordinances of the Village or laws of the State of Ohio, shall have the same force and effect as an ordinance of Council.

937.03 WATER AND SEWER CONNECTION CHARGES.
   (EDITOR’S NOTE: Former Section 937.03  was repealed by Ordinance 35-99, passed September 1, 1999.)
937.04 WATER SYSTEM CAPACITY CHARGES.
   A water system capacity charge shall be made for each new service branch to any property and shall be paid at the time that the application for the connection permit is made for the service. This charge shall be in addition to any other fees or charges made for water connections and shall be payable to the Village.
   (a)   Prohibition. No person, firm or corporation shall install a service branch, or any part thereof, to the water system of the Village unless he or they have been issued a permit therefor by the Village.
   (b)   A water system capacity charge shall be paid to the Village whenever an application for a connection permit is made for a water service tap to be connected to a water line which is part of or will become a part of the Village’s water system, or which is built by or under the direction and/or supervision of the Village. No water service tap shall be connected to such water lines without a connection permit first being issued by the Village.
Upon proper proof of hardship, the Village Administrator may arrange for a payment schedule for the foregoing capacity charge.
   (c)   Capacity Charges:

      (2)   Any water service tap larger than those set forth herein shall be the subject of a special action by Council prior to issuance of a connection permit.
      (3)   Water service taps shall not be smaller than the water service line connecting the tap to the property or facility serviced.
      (4)   Property owners of record as of the effective date of this subsection (c) where water lines are either existing or presently under construction as of the effective date and where there is an existing residence or business as of the effective date shall be allowed to be issued a connection permit at the capacity charges in effect immediately preceding the effective date hereof if application for same is made within sixty days of the effective date hereof. Connection permits issued pursuant to this subsection shall be valid for a period of ninety days from the date of issuance or for a period of ninety days after completion of construction, if applicable, whichever is later.
      (5)   Except as otherwise provided under subsection (c)(4) hereof, all connection permits issued pursuant to this section shall be valid for a period of ninety days from the date of issuance.
      (6)   In the event that water usage does not commence within the validity period of any connection permit issued under this section, then an application for a new connection permit must be submitted and an additional water system capacity charge shall be paid, at the time of such application submittal, equal to the greater of:
         A.   The difference between the charges stipulated in subsections (c)(1) through (c)(5) hereof and the amount previously paid, or
         B.   Fifty dollars ($50.00).
      (7)   Water system capacity charges shall be deposited into the Village’s Water Replacement & Improvement Fund.

937.05 WASTEWATER SYSTEM CAPACITY CHARGES.
   A wastewater system capacity charge shall be made for each new wastewater connection to any property and shall be paid at the time that the application for the connection permit is made for the service. This charge shall be in addition to any other fees or charges made for wastewater connections and shall be paid to the Village.
   Upon proper proof of hardship, the Village Administrator may arrange for a payment schedule for the foregoing capacity charge.
   (a)   Prohibition. No person, firm or corporation shall make a wastewater connection or any part thereof to the wastewater system of the Village, unless he or they have been issued a permit therefor by the Village.
   (b)   Rates. The Fiscal Officer is hereby authorized and directed to make a wastewater system capacity charge whenever an application is made for sanitary sewage collection service from a structure or units whenever such property is or may be serviced by a wastewater connection line connected to a tributary directly or indirectly to any public wastewater system built by or under the supervision of the Village. These charges shall be according to the size of the water main tap that supplies water to the structure or units.
   (c)   Capacity Charges.
      (1)   Waterwater system capacity charges for wastewater service shall be as follows:

      (2)   Where all or a determined portion of a water service tap is installed for fire protection, no normal use of wastewater is anticipated and therefore, no wastewater system capacity charge shall be levied on that portion used solely for fire protection.
      (3)   In the event a water service tap is enlarged, the wastewater system capacity charge difference between the two diameter sizes shall be paid to the Village.
      (4)   Any wastewater system capacity charge where the water service tap is larger than those set forth herein shall be the subject of a special action by Council prior to issuance of a connection permit.
      (5)   All wastewater system service connections and lines shall be approved by the Village Administrator.
      (6)   Property owners of record as of the effective date of this subsection (c) hereof, where wastewater lines are either existing or presently under construction as of such effective date and where there is an existing residence or business as of such effective date shall be allowed to be issued a connection permit at the capacity charges in effect immediately preceding the effective date hereof if application for same is made within sixty days of the effective date hereof. Connection permits issued pursuant to this subsection shall be valid for a period of ninety days from the date of issuance or for a period of ninety days after completion of construction, if applicable, whichever is later.
      (7)   Except as otherwise provided under subsection (c)(6) hereof, all connection permits issued pursuant to this section shall be valid for a period of ninety days from the date of issuance.
      (8)   In the event that wastewater usage does not commence within the validity period of any connection permit issued under this section, then an application for a new connection permit must be submitted and an additional wastewater system capacity charge shall be paid, at the time of such application submittal, equal to the greater of:
         A.   The difference between the charges stipulated in subsections (c)(1) through (c)(4) hereof and the amount previously paid, or
         B.   Fifty dollars ($50.00).
      (9)   Wastewater system capacity charges shall be deposited into the Village’s Sewer Replacement and Improvement Fund.
