§ 98.01 PURPOSE.
   The purpose of this chapter is to provide outdoor lighting standards and regulations that maintain Heath’s quaint rural character, decrease light pollution while maintaining property safety, preserve views of the night sky, and promote energy efficiency, community health, and harmony between neighbors.

§ 98.02 GENERAL.
   (A)   Scope. This chapter applies to outdoor lighting on all non-residential properties within the city limits. The provisions of this chapter are not binding in the extraterritorial jurisdiction (ETJ) of the city. However, compliance is strongly encouraged.
   (B)   Prohibition. A property owner commits an offense by doing the following:
      (1)   Installs outdoor lighting contrary to this chapter; or
      (2)   Fails to comply with any terms or conditions set forth in a permit issued under this chapter.
   (C)   Nuisance. A violation of this chapter is hereby declared to be a prohibited public nuisance.
