(A) Scope. This chapter applies to outdoor lighting on all non-residential properties within the city limits. The provisions of this chapter are not binding in the extraterritorial jurisdiction (ETJ) of the city. However, compliance is strongly encouraged.
(B) Prohibition. A property owner commits an offense by doing the following:
(1) Installs outdoor lighting contrary to this chapter; or
(2) Fails to comply with any terms or conditions set forth in a permit issued under this chapter.
(C) Nuisance. A violation of this chapter is hereby declared to be a prohibited public nuisance.
