OFFICERS
(A) Security bond. The City Clerk, before entering upon the duties of his or her office, shall execute to the city a bond in the penal sum of $4,000 with such sureties as the Council may approve, conditioned as provided by law.
(B) Statutory duties. The duties of the City Clerk shall be those prescribed by the state statutes and such others as shall be imposed upon him or her by the ordinances of said city.
(C) Records. The City Clerk shall, under the direction of the Chairperson of the Committee on Finances and Auditing, open and keep in a neat and methodical manner a complete set of books in which, among other things, shall be set forth the appropriations of the fiscal year for every distinct object and expenditure and also the receipt from every source of revenue so far as he or she can ascertain the same. Said books and all contracts, bonds, deeds, warrants, vouchers, and other papers kept in said office shall be subject to the examination of all members of the Council and all city officers.
(D) Warrants of Treasurer. He or she shall keep, in a suitable book, an accurate list of all warrants drawn upon the City Treasurer showing the date of and amount of each and the name of the person in whose favor drawn. All warrants drawn upon the Treasurer shall be signed by the Mayor and countersigned by the Clerk and shall specify therein the particular fund or appropriation to which the same is chargeable and the person to whom payable, and no money shall be otherwise paid than upon such warrants so drawn.
(E) Funds and appropriations. Whenever any appropriation or fund is exhausted, the Clerk shall, without delay, notify the Council thereof, and he or she shall not thereafter draw any warrant against such fund or appropriation until the same shall be renewed. It shall be the duty of said Clerk to transfer and place to the credit of the General Fund all unexpended balances or appropriations remaining at the close of the fiscal year.
(F) Public improvements. Said Clerk shall keep in his or her office a correct list of all public improvements ordered by the Council and let under a contract by the city, and all contracts and specifications therefor made by the authority of the Council or by any officer of the corporation pursuant thereto, in relation to such improvements, shall be filed in the Clerk’s office.
(G) Licenses. All licenses, when issued, shall be entered by the Clerk, without fee, in a book to be kept by him or her for that purpose, the name of each person licensed, for what purpose licensed, and the date and number of the license, the amount paid for the same, and the time of the expiration thereof.
(H) Monthly statement. The Clerk shall, on or before the first Monday in each and every month, make out and submit to the Council a statement or report, in writing, of all monies received and warrants drawn by him or her during the preceding month, showing therein from what source and on what account said monies were received and for what purpose and on what account said warrants were drawn or ordered.
(I) Annual report. Said Clerk shall, within 20 days after the beginning of the fiscal year in each year, make out an annual report giving a detailed statement of all the receipts and revenues of said city during the preceding fiscal year. Said report shall also detail the resources and liabilities of the city, the condition of all appropriations and contracts unfulfilled, the balance of money then remaining in the treasury with all sums due and outstanding, and all other matters necessary to exhibit the true financial condition of the city, which report, when examined and approved by the Chairperson of the Committee on Finances and Auditing, shall be filed.
(J) Office hours. The hours of the City Office of the City Clerk shall be from 8:30 a.m. to 4:00 p.m. local time, Monday through Friday.
(K) Expense estimate. In addition to his or her other duties, the said Clerk shall, on request of the City Council, on or before May 15 in each year and before the annual appropriations are made by the Council, submit to said Council a statement of his or her estimates as nearly as may be of money necessary to defray the expenses of the corporation during the current fiscal year. He or she shall, in said report, classify the different objects and branches of expenditure, giving the amount required for each as nearly as may be, and for the purpose of making such report, he or she is authorized to require of all city officers statements of the condition and expenses of their respective offices or departments with any proposed improvements and the probable expense thereof, and he or she shall give therein such other information to the Council or its members as may be necessary to the end that said Council may fully understand the money exigencies and demands upon the city for the current year. In addition to his or her other duties, he or she shall keep a record in a separate journal, showing certified copies of all ordinances passed by the Council.
(L) Collection. It shall be the duty of the City Clerk to collect all sums of money now due and owing to said city or which shall become due and owing to said city on sales of lots in the city cemetery (known as the Greenwood Cemetery), on water rents, for the construction of sidewalks and all special assessments, rents from city property, back taxes, licenses, or any other money which shall become due in any other manner except by judgment of court, and he or she shall, immediately upon collection of any city revenue, pay the same over to the City Treasurer.
(M) Keeping seal, records. Said Clerk shall be the keeper of the corporate seal of said city; he or she shall prepare all commissions, licenses, permits, and other official documents required to be issued by him or her under the laws and the ordinances of the city; and he or she shall, when necessary, attest all instruments with the corporate seal of said city. He or she shall carefully preserve in his office all books, records, papers, deeds, maps, and effects of every description belonging to the city and appertaining to said office, and upon expiration in any way of his or her official term, he or she shall, on demand, deliver all such books, records, papers, and effects to his or her successor in office and shall perform such other duties appertaining to his or her office as may be required by the ordinances of said city or by the state law.
(N) Salary. Beginning May 1, 2021, the salary of the City Clerk shall be $1,200 per year.

(A) Security bond. The City Treasurer, before entering upon the duties of his or her office, shall execute a bond to the city in the sum of $15,000 with surety to be approved by the Council, condition as required by law.
(B) Receiving money. He or she shall receive all monies belonging to the city and shall render at the end of each month and more often, if required, a statement under oath to the Committee on Finances and Auditing showing the state of the treasury at the date of such account and the balance of the money in the treasury. Such statement shall set forth all the monies received by him or her and from whom and on what account they shall have been received and, also, all money paid out by him or her and on what account it shall have been paid.
(C) Books of account. Said Treasurer shall cause to be kept books of account in such manner as to show, with entire accuracy, all monies received by him or her and from whom and on what account it shall have been received and all monies paid out by him or her and on what account it shall have been paid and in such manner that such books may be readily understood and investigated. Such books and all papers and files in his or her office shall be, at all times, open to the examination of the Mayor or any member of the Council.
(D) Bank deposits. The City Treasurer shall deposit the funds of the city in such bank or banks as may be designated according to law and shall make to the Committee on Finances and Auditing, annual report under oath of all interest on monies received or credited to the City Treasurer or to the city by any such bank in which is deposited any monies of the city including special assessments.
(E) Other duties. He or she shall perform such other duties usually incident to the office of City Treasurer as may from time to time be required by the Mayor or any member of the Council and such other duties as may be required to be performed by any other city ordinance or by law.
(F) Term of office. The City Treasurer shall hold office for a term of four years and until his or her successor is elected and qualified.
(G) Salary. Beginning May 1, 2023, the salary of the City Treasurer shall be $7,000.

(A) Term of office. There is hereby created the office of City Attorney, who shall hold his or her office for one year or until his or her successor shall be elected and qualified.
(B) Election. He or she shall be elected at the first regular meeting of the Council in May of each year or as soon thereafter as may be practicable.
(C) Security bond. The City Attorney, before entering upon the duties of his or her office, shall execute a bond to the city in the sum of $1,000 with such sureties as the Council shall approve and conditioned as provided by law.
(D) Assigned duties. He or she shall draft such ordinances as may be required by him or her by the Council or by any member thereof. He or she shall draw any deeds, leases, contracts, or other papers required by the business of the city when requested to do so by the Mayor or any member of the Council. He or she shall, when requested to do so, furnish written opinions upon subjects submitted to him or her by the Mayor, the Council, or by any member thereof and shall conduct all the legal business of the city. He or she shall be charged with the prosecution of all action for violations of the ordinances of the city and with the conduct of all cases in courts of justice. He or she shall institute action in every case where there has been a violation of any city ordinance when instructed to do so by the Council or any committee thereof or upon the complaint of any person when, in his or her judgment, the public interest requires the same shall be prosecuted. He or she shall perform such other duties usually incidental to the office of City Attorney as may be required by the Mayor or any member of the City Council. Whenever, in the opinion of the Mayor, the interests of the city may require it, assistant counsel may be employed at the expense of the city.
(E) Duties not assigned. This section shall not be intended, however, to require the City Attorney to do the legal work in connection with the Board of Local Improvements or the legal work in connection with any improvement to be paid for by special assessment.
(F) Salary. The City Attorney shall receive a salary of $210 per month, payable monthly.

(A) Creation of office. There is hereby created a city department to be referred to as the Police Department.
(B) Appointment of police officers and term of office. Police officers of the city shall hold office by appointment of the Mayor and with the approval of the City Council, and the term of office for each police officer shall be for one year or until a successor is appointed and qualified.
(C) Police officers in charge. Each police officer shall be designated by a badge number, and the Chief of Police shall be in general charge of the Police Department and responsible for the supervision of all other police officers. The Chief of Police shall also attend all regular and special meetings of the City Council.
(D) Eligibility requirements. No person shall be eligible for the office of police officer unless he or she shall, at the time of his or her appointment, be at least 21 years of age, be an actual resident of the city, and be of good moral character and have a telephone in his or her home or residence. Part-time police officers are not subject to the residency requirement.
(E) Residency requirement and vacancy. Any person who is appointed a police officer must continue to actually reside in the city, and if any appointee shall ever reside outside said city or fail to meet any other qualification in this section, then the office shall be, by the City Council, declared vacant, and the vacancy shall be filled by appointment by the Mayor with the approval of the City Council.
(F) Salary. The salary of the Chief of Police shall be fixed for each term by the City Council by a resolution at the time the office is filled by appointment.
(G) Powers and duties. Police officers shall have all the powers and duties now specified by law or ordinance and such other duties and powers as specified by regulations hereinafter referred to, promulgated by the Health and Safety Committee, and approved by the City Council from time to time.
(H) Removal from office. Police officers shall, at all times, be subject to control by the City Council and may be removed from office by the City Council for failure or refusal to comply with any lawful direction of said Council or the Health and Safety Committee of said Council or for a failure or refusal to discharge any duties.
(I) Vacancy. A vacancy in the office of Chief of Police shall exist by reason of death, resignation, removal from the said city, inability to discharge the duties of the office by reason of ill health or other cause, and by removal from office by action of the City Council; when any such vacancy shall exist, the said office shall be filled in the same manner as provided in division (C) above.
(J) Surety bond. The Chief of Police shall, before entering upon the duties of his or her office, take and subscribe the oath required of other officers and file the same with the City Clerk and shall also execute a bond to the city in the penal sum of $1,000 with surety to be approved by the Council, and the conditions of said bond to be the same as in the case of other city officers.
(K) Enforcement of ordinances. The Chief of Police shall be charged with the enforcement of all the ordinances of the said city. He or she shall report to the Health and Safety Committee or the Council any violation of any ordinance and shall bring proper action in courts of justice against any and all violators of such ordinances. The Chief of Police shall be ex-officio Prison Keeper of said city, and all police officers shall be under his or her control and command, except that he or she and other police officers shall, at all times, be subject to the direction of the Health and Safety Committee.
(L) Council meetings and other duties. The Chief of Police shall attend or ask one of the other police officers to attend all meetings of the Council, execute all its orders, and close the Council Chamber upon the adjournment of that body. He or she shall also execute all warrants or legal processes required to be executed by him or her under any ordinances of the city.
(1) Such Chief of Police shall keep either the original or a copy of each execution, mittimus, or warrant of commitment and return the same to the Magistrate who committed such person, showing how he or she executed the same.
(2) Said Chief of Police shall have the care, custody, and control of all books, records, equipment, and other property belonging to the police authority. Upon the expiration of his or her term of office or his or her resignation or removal therefrom, he or she shall surrender to his or her successor in office all books, records, equipment, and property of every description in his or her possession belonging to the city or appertaining to his or her said office.
(3) All police officers, in addition to the other duties required of them, shall be night police officers of the city and keeper of the Council Chamber and City Jail. When acting as night police officers, they shall maintain headquarters at the City Hall. The hours of continuous service as such night police officers shall be from 4:00 p.m. to 12:00 a.m. and 12:00 a.m. to 8:00 a.m., but nothing in this section contained shall be held to limit the Chief of Police duties to these hours, but on the contrary, he or she shall be subject to call for police duty at all times.
(4) All fees charged and collected by said Chief of Police in connection with the prosecution of any offense under the ordinances of said city shall be paid over to the City Treasurer.
(M) Street lights.
(1) It shall be the duty of the night police officers to carefully note the hours in which the street electric lights of the city may fail to render efficient service during the hours when said lights should be brightly burning according to contract.
(2) The Chief of Police shall file with the Council a statement of the hours of non-service of each lamp and the date of such non-service. Said statement shall also show the total number of hours of non-service together with the total hours of required service for the month preceding the date of filing said statement. The Chief of Police shall file his or her statement with the Council not later than the Saturday preceding the first Monday of each month.
(N) Engaging in business prohibited. During his or her term of office, a police officer shall not be engaged in any other business or occupation without prior approval of the City Council.
(O) Regulations of City Police Department.
(1) Responsibility for shift. Each police officer shall be responsible for his or her own shift, and the reports, paper work, and keeping of the log in relation to the happenings and occurrences on said shift and for the completion and filing of such papers.
(2) Shifts and duties applicable thereto. There shall be three shifts, namely: shift one, being 8:00 a.m. to 4:00 p.m.; shift two, being 4:00 p.m. to 12:00 a.m.; and shift three, being 12:00 a.m. to 8:00 a.m. Police officers shall rotate on shifts one, two, and three by badge number. Shifts shall be assigned in accordance with the following example in divisions (O)(2)(a) through (O)(2)(c) below.
(a) The first week hereafter, the Chief of Police shall have shift one, Badge No. 2 shall have shift two, and Badge No. 3 shall have shift three.
(b) On the second week, the Chief of Police shall have shift three, Badge No. 2 shall have shift one, and Badge No. 3 shall have shift two.
(c) The third week, the Chief of Police shall have shift two, Badge No. 2 shall have shift three, and Badge No. 3 shall have shift one.
(3) Log book and reports. Activities, happenings, and occurrences on the shift must be recorded in the log book, which shall, at all times, be available to the members of the Health and Safety Committee and the Mayor.
(4) Night duties. The police officer on shift two, that is from 4:00 p.m. to 12:00 a.m., and on shift three, from 12:00 a.m. to 8:00 a.m., shall be responsible for checking the doors of all businesses and reporting street lights that are out along with other regular duties. It shall be the duty of all police officers during each shift to pick up dogs running at large or issue a ticket to the owner of the dog, if reasonably possible, if the dog cannot be caught.
(5) Coffee breaks. During each shift there shall be only two coffee breaks allowed for a period of 15 minutes each.
(6) Police equipment. Police equipment not being used (such as the extra guns, holsters, badges, radar gun, and tranquilizer gun and other equipment not being used) are to be locked in the safe in the Clerk’s office and checked out as needed and checked back in after the need is over. The radar gun is to be used only when designated by the Health and Safety Committee. Each officer is furnished one uniform after 90 days from the start of full-time employment and an allowance twice a year for uniform replacement. Uniforms furnished to part-time officers must be returned to the City Clerk at the end of employment before receiving a final paycheck.
(P) Chief of Police to patrol park district; conditions.
(1) It is in the interest of the city, the users of the grounds and the facilities of the city park district (herein called the “district”) and the general public that the ordinances of the district and its rules and regulations, together with the ordinances of the city and the applicable laws of the state, be enforced in the district including, but not limited to, the park grounds and facilities of this district.
(2) It is in the interest of the city that the city furnish to the district the services of its police officers for the enforcement of the ordinances, rules, regulations, and laws designated in division (P)(1) above.
(3) The city shall, upon authorization by ordinance of the district, furnish said district and its park grounds and facilities with police protection through the police officers of said city who shall enforce the ordinances, rules, and regulations of the district; the city ordinances of the city; and the applicable laws of the state in the territory of the district including, but not limited to, its park grounds and facilities, and for the foregoing purposes, the police officers of said city have the right, power, and authority to enter upon, at any time, the park grounds and facilities of the district.
(4) The police officers of the city, when acting pursuant to this division (P), shall have all the powers, authorities, and rights which they would have under law if they were appointed police officers of the district by the Board of Park Commissioners thereof.
(5) This district shall be under no obligation to pay to said city any expense of the said city in furnishing police protection to this district under this division (P); provided, however, this district shall be liable to pay all court costs and witness fees which may be incurred in the enforcement of the ordinances, rules, regulations, and laws designated herein and which are not paid by any defendant or defendants in court proceedings.
(6) Pursuant to 745 ILCS 10/7-101 and 745 ILCS 10/7-102, the district shall assume all liability for and indemnify the city from all liability for any injury to the person or property of any third party or entity occurring while any officer of city is acting pursuant to the powers herein granted, and the district shall procure and maintain liability insurance coverage insuring the city police during their performance under this agreement.
(7) The attorney for the district shall prosecute all violations occurring within the district, not prosecuted by the County State’s Attorney.

(A) Creation of office. There is hereby created the office of Public Works Director in the city.
(B) Appointment and term of office. Hereafter, the Public Works Director of the city shall hold office by appointment by the Mayor with the approval of the City Council, and the term of office shall be for one year and until his or her successor is appointed and qualified.
(C) Eligibility requirements. No person shall be eligible for the office of Public Works Director unless he or she shall, at the time of his or her appointment, be at least 21 years of age, shall be of good moral character, and have a telephone in his or her residence or home.
(D) Application for office. Any person desiring to be appointed Public Works Director may file with the City Clerk a written application for said office on or before April 1 in the year in which he or she seeks such appointment.
(E) Residency requirement. Any person who is appointed Public Works Director must continue to actually reside in said city, and if any appointee shall reside outside said city, then the office shall, by the City Council, be declared vacant, and the vacancy shall be filled by the appointment by the Mayor, with the approval of the City Council, of some qualified person to such office without any written application therefor being required, and any person appointed to fill a vacancy in office which occurs for any reason shall hold office until his or her successor is appointed and qualified.
(F) Compensation. The compensation of the Public Works Director shall be fixed by the City Council by resolution at the time the office is filled by appointment. The compensation of the said Public Works Director shall be paid from the particular fund of the department of the city government under whose direction he or she is at any time employed, and his or her compensation, when paid, shall be prorated from the funds of the several departments of said city government by whom he or she has been employed.
(G) Powers and duties. The Public Works Director shall have all the powers and duties now specified by law or ordinance and shall have such other duties and powers as the City Council shall from time to time specify.
(H) Removal from office. The said Public Works Director shall, at all times, be subject to the control of the City Council, and he or she may be removed from office by the City Council for a failure or refusal to comply with any lawful direction of said Council or the Public Works Committee of said Council or for a failure or refusal to discharge any of his or her duties.
(I) Vacancy. A vacancy in the office of Public Works Director shall exist by reason of death, resignation, removal from the said city, inability to discharge the duties of the office by reason of ill health or other cause, and by removal from office by action of the City Council; when any such vacancy shall exist, the said office shall be filled in the same manner as provided in division (D) above.
(J) Security bond. The Public Works Director shall, before entering upon the duties of his or her office, take and subscribe the oath required of other officers and file the same with the City Clerk and shall also execute a bond in the penal sum of $1,000 with surety to be approved by the Council, the conditions of said bond to be the same as in the case of other city officers.
(K) Supervision of construction and maintenance. Subject, at all times, to the orders and directions of the Public Works Committee, he or she shall have full control over all persons employed in the construction and maintenance of the streets and sidewalks of said city. He or she shall keep such time books as may be directed by said Committees and shall perform such other duties as are necessary to the fulfillment of the purposes of his or her office.
(L) List of materials and equipment. It shall be the duty of the Public Works Director to keep a correct list of all implements, materials, and other property of the city in his or her charge or possession, and upon the expiration of his or her term of office or his or her resignation or removal therefrom, he or she shall deliver said property to his or her successor in office, taking a receipt therefor which he or she shall immediately file with the City Clerk, who shall credit him or her with the same and charge his or her successor therewith.
(M) Account of expenditures. Said Public Works Director shall keep in an appropriate book, an accurate account of his or her expenditures made under his or her supervision, and the hours of time consumed therein so that the total costs and time consumed of any certain piece of street work may be ascertained upon the completion thereof.
(N) Enforcement of ordinances. Said Public Works Director shall cause all ordinances in relation to streets, alleys, and sidewalks to be enforced and shall file complaints and prosecute in the name of the city, all persons for violation thereof. He or she shall, under the direction of the Public Works Committee, be charged with the construction, maintenance, repair, inspection, and supervision of all sidewalks, culverts, and bridges of said city and shall, whenever the condition of any such sidewalk, culvert, or bridge is deemed by him or her to be unsafe or likely to result in damage to the city or to any person, make immediate report of such condition to the Council or to the Chairperson of the Public Works Committee, as the case may require.
(O) Duties imposed by city. The said Public Works Director shall be subject to duties imposed and directed by any department of the city government, provided that such duties and the imposition of them are not in conflict with the plans of the Public Works Committee.
(P) Manual labor. The said Public Works Director shall, when necessary, act in the capacity of a maintenance person, actually laboring upon the streets and fulfilling, by manual labor, the purposes of his or her office, as well as acting as a foreperson of a crew of workers.
