4-7-1: UNLAWFUL CONDITIONS:
   A.   It shall be unlawful for any person who owns, occupies or controls any premises in the village to perform or authorize to be performed any grading, filling or excavating activity on such premises, in a manner that increases the grade of such premises or alters overland drainage routes resulting in an impact on neighboring properties, including impeding, redirecting or increasing the volume of the natural flow of surface stormwater from or onto adjoining property.
   B.   Any resident person desiring to obtain review of any grading, filling or excavating activity that is not authorized by a building permit shall apply for a site development permit, on forms provided by the village. A resident implementing work in accordance with a site development permit will be presumed in compliance with this chapter. However, this chapter does not create liability on the part of the village or any officer or employee thereof for any flood damage that results from reliance on this chapter or any administrative decision made lawfully thereunder.
   C.   The village engineer may require that the applicant submit plans and specifications for drainage plans, certified by a professional engineer and indicating the direction of existing and proposed stormwater flow on the site and other information as necessary to verify that the proposed site work will not impede or materially alter the natural flow of surface stormwater on or along the lot. Village fees for review and issuance of a site development permit shall be as set forth from time to time in the village fee schedule.
