All water sold or supplied by the village shall be used for domestic purposes only, except as hereafter enumerated, and shall be paid for at the rates herein fixed: (Ord. 06-06, 6-12-2006)
A. Water Use Within Village Limits: Effective March 2009, water consumed within the village limits will be billed per three (3) month period at six dollars fifty two cents ($6.52) per one thousand (1,000) gallons, with a minimum charge of ten dollars ($10.00) for said period.
B. Water Use Outside Village Limits And Commercial Accounts: Effective March 2009, water consumed outside the village limits will be billed per three (3) month period at six dollars ninety eight cents ($6.98) per one thousand (1,000) gallons, with a minimum charge of fifteen dollars ($15.00) for said period. C. Due Date; Minimum Payment; Service Charges: Billing for residential water service shall be done quarterly. Water bills shall be payable by the owner or occupant of the property receiving the service on or before the payment due date stated in the water bill. Payment due dates will be at least twenty five (25) days from the invoice date. The total minimum payment due each billing cycle will be the sum of the current invoiced amount plus all past due amounts, which may include village service charges and late fees. For water bills not paid after twenty five (25) days, a reminder notice will be sent to the billing address on record. For water bills not paid by forty five (45) days from the invoice date, there shall then be added to the bill and thereafter due to the village a service charge of twenty five dollars ($25.00). For the bills that remain unpaid more than sixty (60) days after the invoice date, the village may send a second late notice via certified mail to the billing address on record at the water department and thereafter there shall be due to the village an additional service charge of twenty five dollars ($25.00) and then the total unpaid balance will be charged a one percent (1%) per month (12 percent per year) late fee, starting from the payment due date until the account balance is paid in full.
D. Foreclosure Of Lien: If any delinquent water bill is not paid within one hundred eighty (180) days after rendition of the bill, and without regard to any other remedy that the village may have or may have exercised, the lien provided in section 7-1-13 of this chapter may be foreclosed in the same manner as a mortgage foreclosure by appropriate legal action in the circuit court of Cook County. The fees and costs incurred by the village to prosecute such foreclosure action, including all attorney fees (including the initial fee assessed in the fee schedule for preparation and recording of the lien), fees for the village engineer and other opinion witnesses, costs of depositions and court reporters and court filing fees, shall constitute additional delinquent water supply user charges for which the village is entitled to receive payment.
