§ 25-4 SOLICITATION PERMIT.
   (a)   Application procedure. Each applicant for a solicitation permit shall file with the village manager a properly completed application therefor on a form provided for such purpose by the village manager. Every such application shall be filed at least seven days in advance of the first day for which authorization to solicit is sought. Each applicant shall verify under oath all statements made on or in connection with the application. Every individual identified in an application who seeks to engage in solicitation other than exempt minors described in § 25-3 of this article must present him or herself at the village department of public safety to be fingerprinted and photographed for a fee of $ 65 per applicant. A new application shall be required to solicit after the expiration of any permit issued hereunder. Each application shall contain, at a minimum, the following information and materials:
      (1)   The applicant’s name, business address (if any) and current residence address, and, if the applicant is an individual, the length of time the applicant has resided at such address;
      (2)   The name and address of the entity on whose behalf the applicant will be soliciting, if different from the information in subsection (1) above;
      (3)   If the applicant is an individual, each of the applicant’s residence addresses in the previous three years, if other than the applicant’s current residence address;
      (4)   If the applicant is an individual, a copy of a government-issued photo identification card for the applicant;
      (5)   The name and address of the entity, if any, that employs the applicant for the purpose of conducting solicitation in the village, and the length of the applicant’s employment with such employer;
      (6)   The name, address and telephone number of a principal officer or director of applicant’s business or organization who has authority to act on matters related to the application, and the business’s or organization’s registered agent for service in Illinois, if any;
      (7)   If more than one solicitor shall be soliciting on behalf of an entity, then the names(s), address(es) and telephone number(s) of the person(s) who will be in direct charge of the solicitors on behalf of such entity;
      (8)   A description of the subject matter and purpose of the applicant’s solicitation;
      (9)   The date(s) on which the proposed solicitation would be conducted;
      (10)   Information regarding the use or revocation, within the previous five years, of any prior solicitation permit issued by the village or any other municipality to the applicant or the business or organization the applicant represents;
      (11)   Information regarding the applicant’s violation, currently or at any time in the previous five years, of any of the provisions of this article, or of any local, state or federal solicitation regulation;
      (12)   Information regarding whether the applicant has ever been convicted of a felony under the laws of the State of Illinois, any other state or the United States, and the nature of any such conviction;
      (13)   A statement of whether the applicant is authorized by any other governmental entity to solicit;
      (14)   If the applicant is a corporate entity, evidence that the applicant is registered to conduct business in the State of Illinois and is in good standing with the state;
      (15)   If the applicant is a charitable organization, as defined by the Illinois Solicitation for Charity Act, ILCS Ch. 225, Act 460, §§ 1 et seq., evidence that the applicant is registered with the Illinois Attorney General; and
      (16)   If the applicant will use a vehicle in connection with the proposed solicitation, a description of the applicant’s vehicle including the make, model, year of production, and license plate number.
   (b)   Issuance.
      (1)   The village manager shall issue a solicitation permit to an applicant within three business days after the village manager receives a complete application, if but only if the manager finds and determines all of the following:
         A.   The applicant has properly provided all information required by this article or reasonably requested by the village manager and the application and the material statements made in the application are true;
         B.   The applicant has not been convicted of a felony under the laws of the State of Illinois, any other state or the United States within five years immediately prior to the date of filing of the application;
         C.   The village has not revoked or suspended the applicant’s right to solicit in the village within five years immediately prior to the date of filing of the application, nor has any other municipality revoked or suspended the applicant's right to solicit within its jurisdiction during the same period; and
         D.   The applicant has not been found in violation of any provision of this article, or of any provision of any previous village solicitation regulation or other local, state, or federal solicitation regulations, within five years immediately prior to the date of filing of the application.
      (2)   The village manager may issue a permit based solely on the information contained in an application, but the manager shall retain the right (without the obligation) to conduct investigations with respect to any applicant or the information contained in any application.
   (c)   Denial. If the village manager determines that the applicant has not met one or more of the conditions set forth in subsection (b) of this § 25-4, then the village manager shall deny issuance of the solicitation permit and shall give the applicant a written notification and explanation of such denial. The village manager’s notice of denial shall be delivered in person or by first class United States mail addressed to the applicant’s current residence address as set forth in the application, or by e-mail if the applicant has requested to receive communications by e-mail. The solicitation permit shall be deemed denied on the day that the notice of denial is delivered or is placed in the United States mail as provided in this subsection 25-4(c), or is sent by e-mail to the e-mail address provided by the applicant. If the village manager does not issue or deny the solicitation permit within five days after the village manager receives the application, then the permit applied for shall be deemed to have been issued. The applicant may appeal the denial of a solicitation permit pursuant to the provisions of § 25-10 of this article.
   (d)   Form and display of permit. A solicitation permit shall be issued on a form established by the village manager. The name of the solicitor and the business or organization the solicitor represents, if any, the date(s) solicitation shall occur under the permit, and the effective dates of the permit shall be printed on the solicitation permit in easily readable form. Solicitation permits also shall bear the name of the village, the signature of the village manager or the manager’s duly authorized designee, and the relevant permit application number. Each solicitor shall prominently display the solicitation permit issued to the solicitor pursuant to this article on the front of his or her person at all times while soliciting within the village.
