The Building Official and his or her deputies, assistants and employees, and any persons assigned by other departments to cooperate with him or her shall have the right, as far as it may be necessary for the performance of their duties, to enter any property or premises, subject to the necessity of obtaining a proper warrant in those instances where entry is refused, in accordance with the "due process" requirements of the Fourteenth Amendment to the United States Constitution. Any person interfering or endeavoring to interfere with them in the proper performance of their duties shall be subject to the penalty provided in Section 1311.99.

Unless otherwise expressly provided, the provisions of this Building and Housing Code apply only to one, two and three-family dwellings, commercial buildings not more than two stories in height, and barns, stables, garages, outbuildings and other structures incident thereto. All structures designed or intended for any other class of occupancy shall be built in accordance with the instructions of the Building Official.

(a) In addition to any other fees or deposits required by other sections of these Codified Ordinances, the Clerk shall charge and collect a deposit in the amount of not less than the amount paid for permit fees pursuant to Section 1311.14 to reimburse the Village for expenses incurred for additional or supplemental engineering, legal, architectural or other professional services rendered as a result of an application for a building permit, for review of a topographic survey or preliminary or final site development plans, for the location or relocation of utilities, for rezoning, or for lot splits, easements or other similar projects requiring the Village's approval or consent.
(b) Such charges for the professional services of the Village Engineer, Law Director and architectural consultants shall be at the rates customarily charged by them for similar services.
(c) In the event that the funds deposited by an applicant, as required in subsection (a) hereof, shall not be sufficient to reimburse the Village in full, the applicant shall deposit additional funds in series of not less than the amount specified in subsection (a) hereof, as requested by the Building Official or the Clerk.
(d) Any sums not used to reimburse the Village, as provided in subsections (a) and (b) hereof, shall be refunded to the applicant not later than sixty days from the completion of the project, the issuance of the permit, or the decision with respect to which the applicant has requested the Village's approval or consent, as the case may be.

The owner of any building, structure, wall, platform, staging or flooring, or any part thereof, where anything in violation of this Building and Housing Code shall be placed or shall exist, and any architect, builder, plumber, carpenter, mason, electrician or other person who may be employed to assist in the commission of any such violation, and all persons and corporations who shall violate any of the provisions or requirements of this Building and Housing Code or fail to comply therewith, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, shall, where no other penalty is provided, be guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
