(a) Whoever violates any provision of this chapter is guilty of a minor misdemeanor.
(b) Each day a violation occurs or continues constitutes a separate offense.
(c) Whoever violates Section 535.02(a)(12) is guilty of a fourth degree misdemeanor for the first offense. Subsequent violations occurring within two years of a prior conviction will result in a third degree misdemeanor for the second offense and a second degree misdemeanor for all offenses thereafter. The following monetary fines shall apply to each corresponding offense:
(1) | First Offense: | A mandatory minimum fine of two hundred dollars ($200.00) |
(2) | Second Offense within two years: | A mandatory minimum fine of three hundred and fifty dollars ($350.00) |
(3) | All Offenses Thereafter within two years: | A mandatory minimum fine of five hundred dollars ($500.00) |
