1363.02 CONVERSION OF ATTICS, CELLARS AND BASEMENTS FOR DWELLING UNITS PROHIBITED; EXCEPTION.
   Conversion of the attic floor, cellar or basement of any building thereby creating a dwelling unit is prohibited.
   (a)   Existing converted dwelling units on the attic floor or cellar not converted prior to April 23, 1935, or not converted in compliance with Section 1311.02 are illegal.
   (b)   Where the conversion is illegal all kitchen and cooking facilities shall be removed from the attic and/or cellar so that none of such facilities shall be maintained thereon.
   (c)   Where a dwelling unit has been created by converting an attic, cellar or basement prior to April 23, 1935, or pursuant to Section 1311.02 and no additional work in violation of Section 1311.02 has been performed, the owner of such attic or cellar shall apply to Council for a nonconforming use subject to compliance with the Building and Fire Prevention Codes. The necessary compliance requirements shall be recorded in the minutes of the hearing and the nonconforming use shall only be granted subject to compliance with such regulations. (Ord. 17-1973.
