551.02 NOTICE FOR REMOVAL.
   (a)   Notice For Removal For Occupied Structures: In addition to all other provisions contained in this chapter, whenever the Building Commissioner ascertains that noxious weeds or excessive growths, as set forth in Section 551.01, are growing on lots or lands within the City, he shall only in the instances where Section 551.03 is invoked, cause written notice to be served upon the owner, occupant or person in control of such lot or lands, that noxious weeds or other excessive growths are growing on such lands, and shall order the owner, occupant or person in control of such lot or lands, to destroy such noxious weeds or excessive growths by any of the methods set forth in Section 551.01, and that such destruction must be commenced and completed within forty-eight (48) hours after the service of such notice.
   The notice may be served by delivering it personally to the owner or leaving it at the owner’s usual place of business or residence, or by posting it in a conspicuous place on the real estate, building or structure involved, or by mailing it to the owner, or by publishing it once in a newspaper of general circulation within the City if it cannot be served in any other ways above mentioned. A copy of said notice will be served upon the Councilperson in whose ward the structure or nuisance is located.
   (b)   Notice For Removal For Vacant Properties: In addition to all other provisions contained in this chapter, where the structure, lot or land is determined by the Building Commissioner to be vacant, the City shall provide notice to the owner or person in control of such lot, by way of posting written notice on the property in question no later than April 15 of the calendar year. Said posting shall serve as notice to the owner, or person in control of the lot, that if at any point throughout that calendar year, the grass or noxious weed growth exceeds the limitations contained in Section 551.01, the City shall have cause to enter the property in question and remove the grass or noxious growth at the cost to the owner or person in control of said lot as set forth in Section 551.05.
   (c)   Every owner, occupant or person in control of any lot or lands situated within the City who fails to comply with the provisions of this section shall be subject to the penalty provided in Section 551.99.
