(A) The Boone County Planning Commission, being the agency receiving all applications for subdivision developments and plat approvals, shall be authorized and directed to collect all inspection fees of the city for the inspection work of the Public Services Department and the Water and Sewer Commission. Those inspection fees collected by the Boone County Planning Commission shall be remitted to the city for the services of the Public Services Department and directly to the Water and Sewer Commission for those inspection services of the Water and Sewer Commission.
(B) The fees to be collected by the Boone County Planning Commission for these inspection services are to be those Schedule of Inspection Fees adopted herein and as set forth in the Appendix to this chapter. For this purpose, the Construction Inspection Fees referred to in the Appendix of this chapter and incorporated by reference herein as if fully set out, shall be and is approved and adopted herein as the inspection fees of the city.
(C) The Boone County Planning Commission shall distribute and remit to the city or its Water and Sewer Commission those fees collected for their respective inspection services on a quarterly basis.

(A) It is understood that any violation of the specification, standards or provisions of the adopted Boone County subdivision regulations as applicable to the city may be subject to a fine or other penalty authorized by KRS Chapter 100.
(B) Specifically, construction work without proper inspection shall constitute a violation. Notification shall be given regarding any violation, including a violation arising from work done without proper inspection. This required notification shall include a written citation or notice of violation to the contractor at the project site, or a letter to the developer of the existing or proposed subdivision. The notification shall be given by the appropriate agency or department and a deadline given to correct any problem or violation.
(C) The property owner, applicant or developer may be advised to stop all construction work at the project site so as to prevent further possible violation and to address the violation at hand. If corrective action is not taken within the time frame set forth in the notification of violation or citation, a criminal complaint pursuant to the Kentucky Revised Statutes, may be filed by the appropriate zoning enforcement officer in Boone District Court or other appropriate forum against the developer of the proposed or existing subdivision, property owner or applicant.

If, after notification as outlined in § 153.12, corrective action relating to a particular violation of the adopted Boone County subdivision regulations is not performed within the time frame set forth in the notification, and the continued violation affects or could potentially affect the public health, safety and general welfare, then the city shall have the authority to stop all work at the site so that the city can take corrective action as needed. If this occurs, the city shall determine whether the corrective action is an emergency and therefore complete the corrective action and the owner of the property shall be responsible to the city for all costs associated with the corrective action. If not paid upon invoicing for these performed by the city, the property owner shall be subject to a lien being placed on the subject property by the city, such lien to be placed of record in the Boone County Clerk's office, to obtain reimbursement of public funds for the work performed.

The city shall indemnify and hold the Boone County Planning Commission harmless from any claim or dispute resulting in the Commission having to make a refund or pay any sum of money to any person, business, company or other entity for the Commission collection of the inspection fees adopted herein on behalf of the city, or its Water and Sewer Commission, and for all costs, damages, penalties, interest or other monetary expenses, including legal fees or court costs or expenses.

Any person violating any of the adopted Boone County subdivision regulations as applicable to the city, or performing work at a subdivision site without inspection shall, upon conviction, be fined not less than $10, but not more than $500, for each conviction on each violation. Each day of violation shall constitute a separate offense.
