1177.08 SMOKING POLICIES.
   Each employer, owner, operator or manager of a business shall, within three months of the adoption of this section (Ordinance 131-1989, passed June 19, 1989), adopt, implement and maintain a written smoking policy which shall, at a minimum, comply with the following:
   (a)   Any nonsmoking employee may object, in writing, to his or her employer about smoke in the workplace.
   (b)   The employer shall, by use of walls, separation, partition or ventilating equipment, create a smoke-free area such as will protect any such nonsmoking employee who objects, in writing, and in the absence of such effective controls, the employer shall entirely prohibit smoking in the workplace.

1177.09 VOLUNTARY DESIGNATION OF NO-SMOKING AREAS.
   The owner, manager or operator of any place where smoking may be otherwise permitted may voluntarily provide and designate all or any part of such area as a no-smoking area.

1177.10 POSTING OF SIGNS.
   "Smoking Permitted" and "No Smoking" signs shall be conspicuously posted in every room, building or other place where smoking is controlled by this chapter, by the owner, manager or other person having control of such room, building or place. Any area designated in Section 1177.07(b), in which there is not provided a nonsmoking area, shall have posted therein a sign stating this fact in a conspicuous place at its entrance.

1177.99 PENALTY.
   Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
