Private Transfer Stations for Nonhazardous Waste
760.01   Permit required; fees.

760.01 PERMIT REQUIRED; FEES.
   (a)   No privately owned transfer station that is located or that is to be located in the City shall begin operations unless a permit therefor is first obtained from the Director of Service. The Director shall issue such a permit only upon finding that:
      (1)   The transfer station is to be located at least 1,000 feet from any residential dwelling unit.
      (2)   Both the owner and the operator of such transfer station have provided proof that they have obtained all necessary State and Federal permits.
      (3)   The transfer station facility complies with all local building and housing codes and any applicable State or Federal regulations.
      (4)   An annual fee of one hundred dollars ($100.00) has been paid.
      (5)   An additional administrative fee of one dollar ($1.00) per ton handled, transferred or processed at the facility will be paid on a monthly basis by the permittee.
   (b)   The Director of Service is hereby authorized to promulgate additional rules and regulations and to devise the appropriate forms to implement this provision.
   (c)   A permit shall be nontransferable. Such a permit shall be revocable at the discretion of the Director of Service upon a showing of a violation of local, State or Federal law or upon a showing of conduct exhibiting willful disregard for public health, safety or welfare. All permits issued under this section shall have a duration of one year.

760.99 PENALTY.
   Whoever violates any of the provisions of this chapter is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
