Effective September 15, 2006, this chapter shall apply to all day care homes in the City. Effective November 6, 2008, this chapter shall apply to child day care centers and child care facilities. A “Day care home” is any home where child day care as defined by Ohio R.C. Chapter 5104 is provided. This includes, but is not limited to, “type A” and “type B” homes as defined in Ohio R.C. Chapter 5104. “Child care” and “child day care centers” are defined in Ohio R.C. Chapter 5104.

Any provider of home day care services or operators of child day care centers or child care facilities shall be responsible for compliance with all applicable City ordinances and State and Federal statutes and regulations pertaining to day care homes, child day care centers or child care facilities.

Any provider of home day care services, a child day care center operator, or child care provider, shall file, and maintain current, on a form provided by the Building and Housing Department, the following information: the address and telephone number of the home where the services will be provided, the names and Ohio driver's license number or non-driver Ohio identification card numbers of the people that will be providing services at the day care home, child day care center or child care facility, and proof of any certificates, licenses, or approval required for home day care operation if any certification, licensure, or approval is required by any agency so regulating day care homes, child day care centers or child care facilities.

(a) Day Care Homes. Inspections of each day care home for conformance with applicable standards set forth in the City Health, Fire and Housing Codes shall be conducted annually by the Building and Housing Department and the Fire Prevention Bureau. The inspections shall be performed by the Building Commissioner or his or her designee and the Chief of Fire Prevention or his or her designee. An annual fee of one hundred dollars ($100.00) shall be imposed on each day care home to cover the cost of both inspections. Should a re-inspection be necessary, a fee of fifty dollars ($50.00) shall be imposed for the first re-inspection and one hundred dollars ($100.00) for each re-inspection necessary thereafter.
(b) Child Day Care Centers or Child Care Facilities. Inspections of each child day care center or child care facility, for conformance with applicable standards set forth in the City Fire Code, shall be conducted annually by the Fire Prevention Bureau, The inspections shall be performed by the Chief of Fire Prevention Bureau or his or her designee, An annual fee of one hundred dollars ($100.00) shall be imposed on each child day care center or child care facility to cover the cost of the inspection. Should a re-inspection be necessary, a fee of fifty dollars ($50.00) shall be imposed for the first re-inspection and one hundred dollars ($100.00) for each re-inspection necessary thereafter.

Whoever violates any of the provisions of this chapter is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
