7-2-1: RESPONSIBLE COUNCIL MEMBER; ADDITIONAL PERSONNEL:
   A.   Council Member Responsible: As soon as possible after his election as such, the mayor shall appoint one member of the city council to be responsible for all functions of the city domestic water system.
   B.   Additional Personnel: Such additional personnel as, in the judgment of the city council are necessary, will be employed for the efficient and effective operation of the city water department. (2015 Code)
7-2-2: DEPOSIT REQUIREMENTS:
   A.   Deposits Required; Charges: There shall be required of all persons, firms or corporations requesting new service connections; or all persons, firms or corporations requesting service on old connections under a new name; and of all persons, firms or corporations whose service has been disconnected or discontinued for any reason, a deposit equal to the sum of the last three (3) months of water charges, to the nearest greater even dollar, when the connection has been in operation, or equal to the sum of two (2) months, minimum charges where the service requested is new. This subsection shall only be in force when deemed necessary by the city council by resolution from them on a case by case basis.
   B.   Deposits Refundable: The deposit provided for in subsection A of this section shall be retained by the city clerk in a separate fund known as "customer's deposits". It shall draw no interest to the depositor. Upon presentation of his receipt or other evidence of payment satisfactory to the city representative in charge, the depositor shall be entitled to the return of his deposit, less any charges for unpaid service, disconnect, connect or reconnect charge. Any customer requesting refund of his deposit shall have his service disconnected and final charge computed. He shall thereafter not be entitled to any service until a new deposit has been made. 7-2-3: SCHEDULE OF RATES:
   A.   Metered Water Rates: Where a meter exists, service charges for each resident, business, school, or organization shall be determined by the city council by resolution.
   B.   Nonmetered Water Rates: Where a meter does not exist, service charges for each resident, business, school, or organization that is connected to the city water system shall be determined by the city council by resolution.
   C.   Occasional Use Rates: When any resident, business, school, or organization shall require water from the city of Eden for occasional purposes such as, but not limited to, BLM firetrucks, commercial or private chemical rigs, etc., the service charge shall be determined by the city council by resolution.
   D.   Exemption From Rates:
      1.   When, in the view of the city council, any resident, business, school, or organization that contributes to various determined purposes on behalf of the city such as, but not limited to, services performed for the city such as backhoe work, welding, outside fire protection, etc., then by resolution of the city council, they may be exempt from water fees stated herein and provided such resolution will list the amount and/or time of the exempt fee.
      2.   The current resolution specifically exempts the First Segregation fire department from subsection C of this section, as listed herein for an indefinite period of time. (2015 Code)
7-2-4: BILLING PERIOD, DISCONTINUANCE OF SERVICE, LAND OWNER’S RESPONSIBILITIES, AND COLLECTION CLERK:
All charges for the municipal water system shall be billed and collected monthly by the city clerk from the land owner. The land owner shall be solely responsible for any and all fees charged by the city for the use of the municipal water system. Said charges shall be paid within thirty (30) days from date of bill. Failure to pay said charges within thirty (30) days from date of bill shall, without further notice, result in discontinuance of all city municipal services, including water services to that particular residence, business or organization user. The city council shall also have the authority to request a designated representative to obtain payment for said water services in an informal way from time to time as the situation may require in lieu of discontinuance of all city municipal services (“Informal Collection Efforts”). On each occasion the city pursues informal collection efforts, the land owner shall be responsible for and shall pay a collection fee of ten dollars ($10.00). The city may recover said informal collection efforts fee by having such assessment certified to the county assessor or other property county officer having charge of making up of the assessment rolls and such assessment shall be placed on the assessment rolls and collected in the same manner as other municipal taxes are collected. 7-2-5: EXCLUSIVE CONTROL OF FACILITIES:
   A.   City Authority: All control, jurisdiction, management, and operation of all facilities of the water system of the city shall be vested in the city as administered by the city council, and in the personnel empowered by such council, and by this code. To perform such functions, such personnel are empowered to enter upon, over, across or into all property whereon or wherein such facilities are located, whether such property be public or private.
   B.   Prohibited Acts: It shall be unlawful for any person, firm or corporation to interfere in any way with the council members or any person empowered by them to maintain and operate the water system of the city, or to tamper with, or turn on or off, any valve, connection, main, pump, lateral or any other device, equipment, machinery, or thing belonging to, connected with, or constituting a part of said water system.
   C.   Penalty: Any violation of this section shall be punishable as a misdemeanor, and in addition to such punishment, the city council is hereby empowered to suspend all water service, either temporarily or permanently, to such offender. (2015 Code)
7-2-6: EMERGENCY DECLARATION; WATER USE RESTRICTION:
   A.   In the event a state of emergency is declared by the city council, the city's potable water shall not be used by persons or entities for irrigation of lawns, whether by sprinkling, flooding, or other means. The right to use the city's potable water for irrigation purposes will be discontinued altogether.
   B.   The city's potable water shall not be available for the filling of tanks, trailers, or other receptacles by persons or entities for any purpose other than personal or household use. (Ord. 2004-2, 8-9-2004)
