These general definitions apply throughout this Part unless specific definitions are otherwise provided for in any subpart in this Part.
Act- the Federal Water Pollution Control Act, also known as the Clean Water Act, as amended, 33 U.S.C. § 1251 et seq. [Ord. 98-5]
Apartment or office use - refers to a building which is intended to be used for continuous or periodic habitation by human beings and containing two or more family dwelling units; or which contains business or professional offices and one or more family dwelling units; or which contain business, professional or any other similar type of office or offices.
Authority - Dover Township Sewer Authority, a Pennsylvania municipal authority.
Biochemical oxygen demand or BOD - quantity of oxygen utilized in the biochemical oxidation of the organic matter under standard laboratory procedures for 5 days at 20° Celsius, usually expressed as a concentration (e.g., mg/L). [Ord. 98-5]
Building sewer - the extension from the sewage drainage system of any structure to the lateral of a sewer.
Categorical pretreatment standard or categorical standard - any regulation containing pollutant discharge limits promulgated by EPA in accordance with §§ 307(b) and (c) of the Act (33 U.S.C. § 1317) which apply to a specific category of users and which appear in 40 CFR, Chapter I, Subchapter N, Parts 405-471. [Ord. 98-5]
Combined Sewer - a sewer designed to receive both sewage and stormwater runoff which has been approved for such purpose.
Commercial or industrial establishment - a separate building, group of buildings, or room or group of rooms, on a parcel of land held in separate ownership wherein a commercial or industrial activity is carried on by any person. It shall include an office room, or suite of rooms in a building accommodating a number of separate offices. Except to the extent that such offices are set apart from each other and provided with separate toilet facilities for employees, each shall constitute a separate establishment. The determination of Dover Township as to what constitutes a separate establishment shall be final. Bills for service rendered to separate parcels of land shall not be combined for the purpose of obtaining quantity rates.
Daily composite sample - a sample consisting of a combination of individual samples, regardless of flow, collected at regular intervals of not more than 1 hour over a period of not lass than 20 hours or more than 28 hours. [Ord. 98-5]
Department of Environmental Protection (DEP) - the Department of Environmental Protection of the Commonwealth of Pennsylvania or its successor.
DEP permit - the permit which is required by the Department of Environmental Protection of the Commonwealth of Pennsylvania for the construction of a new sanitary sewer system or the extension of any existing sanitary sewer system as well as a new water system or the extension of an existing water system.
Developer - any landowner who makes, causes to be made, or proposes to make (as evidenced by submission) a subdivision of land or a land development.
Dissolved solids - that portion of the solids that consist of organic or inorganic molecules and that are present in a true solution in water. The quantity of dissolved solids shall be determined by one of the acceptable methods described in the latest edition of "Standard Methods for the Examination of Water and Wastewater."
Domestic sewage - the water-borne waste derived from ordinary living processes. [Ord. 98-5]
Domestic use - refers to a property which is intended to be used for continuous or periodic habitation by human beings in a single family unit.
EDU (Equivalent Dwelling Unit) - The measure of volume of sanitary sewage or water generated by any room, group of rooms, house, mobile home, or other structure or enclosure occupied or intended for occupancy as separate living quarters by a family or persons living together or by persons living alone.
Environmental protection agency or EPA - the U.S. Environmental Protection Agency or, where appropriate, the Regional Water Protection Division Director, or other duly authorized official of said agency. [Ord. 98-5]
Garbage - solid wastes from the preparation, cooking, and dispensing of food and from the handling, storage and sale of produce.
Grab sample - a sample taken from a wastestream without regard to flow in less than 15 minutes. [Ord. 98-5]
Holding tank - a watertight receptacle, whether permanent or temporary which receives and retains sewage conveyed by a water carrying system and is designed and constructed to facilitate the ultimate disposal of the sewage at another site. [Ord. 2005-08]
Improved property - any property located within this Township upon which there is erected a structure intended for continuous or periodic habitation, occupancy or use by human beings or animals.
Industrial establishments - any room or group of rooms, building or other enclosure used or intended for use in whole or in part, in the operation of one business enterprise for manufacturing, fabricating, processing, cleaning, laundering or assembling any product, commodity or article, or from which process waste, as distinct from sanitary sewage, shall be discharged.
Industrial use - refers to a property which is intended to be used in whole or in part for the manufacture, conversion or assembly of any product, commodity or article.
Industrial waste - waste from industrial or commercial processes as distinct from domestic sewage. [Ord. 98-5]
Industrial wastes - any solid, liquid or gaseous substance or water borne wastes or form of energy rejected or escaping in the course of any industrial, manufacturing, trade or business process or in the course of the development, recovery or processing of natural resources, as distinct from sanitary sewage.
Interference - a discharge, which alone or in conjunction with a discharge or discharges from other sources, inhibits or disrupts the POTW, its treatment processes or operations or its sludge processes, use or disposal; and, therefore, is a cause of a violation of the Dover Township NPDES permit or of the prevention of sewage sludge use or disposal in compliance with any of the following statutory/regulatory provisions or permits issued thereunder, or any more stringent State or local regulations: § 405 of the Act; the Solid Waste Disposal Act, including Title II commonly referred to as the Resource Conservation and Recovery Act (RCRA); any State regulations contained in any State sludge management plan prepared pursuant to Subtitle D of the Solid Waste Disposal Act; the Clean Air Act; the Toxic Substances Control Act; and the Marine Protection, Research, and Sanctuaries Act. Land development - the improvement of one lot or two or more contiguous lots, tracts, or parcels of land for any purpose involving:
(1) A group of two or more buildings.
(2) The division or allocation of land or space between or among two or more existing or prospective occupants by means of, or for the purpose of streets, common areas, leaseholds, condominiums, building groups or other features.
(3) Any other project requiring the approval of the Board of Supervisors of the Township pursuant to any Act or ordinance.
Land planning module - The modules required by the Pennsylvania Department of Environmental Protection under Act 537, the Pennsylvania Sewage Facilities Act, 35 P.S. § 750.1 et seq.
Lateral - that part of the sewer system extending from a sewer main to the curb line or, if there shall be no curb line, to the property line or, if no such lateral shall be provided, then "lateral" shall mean that portion of or place in a sewer which is provided for connection of any building sewer.
New source - any building, structure, facility, or installation from which there is or may be a discharge of pollutants, the construction of which commenced after the publication of the proposed pretreatment standards under § 307(c) of the Clean Water Act if such standards are thereafter promulgated in accordance with that section provided that certain conditions dealing with the construction and siting of that source vis-a-vis other sources are met in accordance with 40 CFR § 403.3(k). Owner - any person vested with ownership, legal or equitable, sole or partial, of any improved property.
Pass through - a discharge which exists in the POTW into waters of the United States in quantities or concentrations which, alone or in conjunction with a discharge or discharges from other sources, is a cause of a violation of any requirement of Dover Township’s NPDES permit, including an increase in the magnitude or duration of a violation. Person - any individual, firm, association, society, trust or group of individuals, partnership, joint venture, public or private corporation, or any other entity of any nature.
pH - the logarithm to the base 10 of the reciprocal of the hydrogen ion concentration expressed in moles per liter. It shall be determined by one of the acceptable methods described in the latest edition of "Standard Methods for the Examination of Water and Wastewater," cited above.
Pretreatment coordinator - the person designated by the POTW who is charged with certain duties and responsibilities by this Part, or a duly authorized representative. [Ord. 98-5]
Pretreatment requirement - any substantive or procedural requirement related to pretreatment imposed on a user, other than a pretreatment standard. [Ord. 98-5]
Pretreatment standard - prohibited discharge standards, (Federal) categorical pretreatment standards, and local limits. [Ord. 98-5]
Publicly owned treatment works or POTW - a “treatment works,” as defined by § 212 of the Act (33 U.S.C. § 1292) which is owned by a state or a municipality. This definition includes any device or system used in the collection, storage, treatment, recycling, and reclamation of sewage or industrial wastes of a liquid nature and any conveyances which convey wastewater to a treatment plant. Also the “municipality” as defined in § 502(4) of the Act, which has jurisdiction over the indirect discharges to and the discharges from such a treatment works. Specific references herein to a POTW refer to the treatment works and municipalities of Dover Township and those municipalities tributary to the Dover Township Treatment Plant. [Ord. 98-5]
Reserved water capacity - the water volume capacity allocated and reserved by a developer.
Sanitary sewage/waste - the normal water-carried household and toilet wastes from an improved property.
Sanitary sewer/sewer - a pipe or conduit which carries sewage, of which storm surface and ground water are not intentionally admitted.
Sanitary sewage system/sewer system - All sanitary sewers, all pumping stations, all force mains, all sewage treatment works, and all other sewage facilities owned or leased to and operated by the Township for the collection, transportation and treatment of sanitary sewage and industrial wastes, together with their appurtenances, and any additions, extensions or improvements thereto. Said term shall also include sewers within the Township which serve one or more properties discharging into the public sanitary sewage system even though such sewers may not have been constructed by the Township and are not owned or maintained by the Township.
Septic tank waste - any sewage from holding tanks such as vessels, chemical toilets, campers, trailers, and septic tanks. [Ord. 98-5]
Sewage - a combination of water-carried wastes from residences, business buildings, institutions, and industrial and commercial establishments, together with such ground, surface or stormwater as may be present.
Shredded garbage - the wastes from the preparation, cooking and dispensing of food and from the handling, storage and sale of produce that has been shredded to such degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than ½ inch in any dimension.
Significant industrial user -
(1) A user subject to categorical pretreatment standards.
(2) A user that:
(a) Discharges an average of 25,000 gallons per day or more of process wastewater to the POTW (excluding sanitary, noncontact cooling, and boiler blowdown wastewater).
(b) Contributes a process wastestream which makes up 5% or more of the average dry weather hydraulic or organic capacity of the POTW treatment plant.
(c) Is designated as such by Dover Township on the basis that it has a reasonable potential for adversely affecting the POTW’s operation for violating any pretreatment standard or requirement.

Slug load or slug - any discharge at a flow rate or concentration which could cause a violation of the prohibited discharge standards in § 26-106.4. [Ord. 98-5]
Standard industrial classification (SIC) code - a classification pursuant to the Standard industrial classification manual issued by the United States Office of Management and Budget. [Ord. 98-5]
Storm sewer - a sewer which is intended to carry stormwater runoff, surface water, groundwater drainage, etc., but which is not intended to carry any sanitary sewage or industrial waste.
Stormwater - any flow occurring during or following any form of natural precipitation, and resulting from such precipitation, including snowmelt. [Ord. 98- 5]
Stormwater runoff - that portion of the rainfall which reaches a channel, trench, sewer, or stream after a storm.
Suspended solids - the solids that either float to the surface or are in suspension in water, sewage, or industrial waste which are removable by laboratory filtration. The quantity of suspended solids shall be determined by one of the acceptable methods described in 40 CFR ,Part 136, and amendments thereto. [Ord. 98-5]
Township - the Township of Dover, York County, Pennsylvania, a Pennsylvania municipality, acting by and through its Board of Supervisors or, in appropriate cases, acting by and through its authorized representatives, or the Township’s assigns or successor in interest. [Ord. 2005-08]
Unpolluted water or waste - any water or waste containing none of the following: Free or emulsified grease or oil; pH less than 6.0 or greater than 9.0; phenols or other substances imparting taste and odor to receiving waters; toxic or poisonous substances in suspensions, colloidal state or solution; obnoxious or odorous gases. It shall contain not more than 500 milligrams per liter by weight of dissolved solids of which not more than 250 milligrams per liter shall be as chloride and not more than 10 milligrams per liter each of suspended solids and B.O.D. The color shall not exceed 50 color units. Analyses for any of the above mentioned substances shall be made in accordance with the latest edition of Standard Methods for the Examination of Water and Wastewater, cited above.
Unit - a unit of dwelling housing one family of equivalent dwelling unit (EDU) See "EDU.” [Ord. 2005-08]
User - any person, as defined above, owning, occupying, or using any property served with water from the water system or the source of wastewater entering the publicly owned treatment works. [Ord. 98-5]
Waste generator - any generator of trucked waste. [Ord. 2005-08]
Wastewater treatment plant or treatment plant - that portion of the POTW which is designed to provide treatment of municipal sewage and industrial waste. [Ord. 98-5]
Water company - any publicly or privately owned duly authorized agency, corporation, municipality or organization which is the approved purveyor of the public water supply within the limits of the Township.
Water system - all water lines, all pumping stations, all force mains, all water works, and all other water facilities owned by or leased and operated by the Township for the distribution, transportation, and treatment of water, together with their appurtenances, and any additions, extensions or improvements thereto. Said term shall also include water lines within the Township which serve one or more properties even though such water lines may not have been constructed by the Township and are not owned or maintained by the Township.
