§ 27-630. Group Home.
   The number of residents permitted in a group home may exceed ten if the following criteria are met:
      A.   No more than two residents may occupy any existing bedroom. Rooms converted to bedroom (i.e. kitchens, dining rooms, etc.) do not qualify.
      B.   Occupancy limitations of the Uniform Construction Code for Dover Township must be complied with; however at no time shall the number of residents exceed ten.
      C.   Parking. The requirement for additional off-street parking (See § 27-703.1) may be waived by the Zoning Hearing Board if evidence is provided that due to the nature of the group
   home, the residents would not operate vehicles. If waived, such parking would need to be added at such point as the nature of the group home changes and parking is deemed to be needed.
      D.   An on-site resident staff person must be present at all times.
      E.   A group home shall be operated and maintained in the character of a residential dwelling in harmony with and appropriate in appearance to the character of the general vicinity in which it is to be located.
      F.   In accordance with the Federal Fair Housing Act, a “Group Home” does not extend to the following persons:
         (1)   Persons who claim to be disabled solely on the basis of having been adjudicated a juvenile delinquent;
         (2)   Persons who claim to be disabled solely on the basis of having a criminal record;
         (3)   Persons who claim to be disabled solely on the basis of being registered as a “sex offender”;
         (4)   Persons who currently use illegal drugs;
         (5)   Persons who have been convicted of the manufacture or sale of illegal drugs;
         (6)   Persons with or without disabilities who present a direct threat to the persons or property of others.
