12.6.402: SERVICE; APPLICATION FOR:

Any person or non-Utilities City department desiring products and/or services shall make application to the Chief Executive Officer for the products and services on a form provided by the Chief Executive Officer. (Ord. 98-173; Ord. 01-42; Ord. 18-42)

12.6.403: SERVICE; CONVEYANCE:

The providing of custom hard copy system products; regular, ongoing system services and technical assistance shall be accomplished for persons by contract and for City departments by memorandum of understanding. Digital data is not to be sold and is to be provided to persons by lease agreement. All rights to digital data are hereby reserved by Utilities. (Ord. 98-173; Ord. 01-42)

12.6.404: SERVICE; PRIORITY:

The providing of products and services other than standard system products is discretionary and cannot take priority over the Utilities' primary responsibilities. (Ord. 98-173; Ord. 01-42)

12.6.501: COPIES OF STANDARD PRODUCTS; RATES AND CHARGES:

A charge shall be collected from persons and non-Utilities City departments for copies they are furnished of routinely developed standard system products. The charge shall be the amount the Chief Executive Officer has approved for each standard product. (Ord. 98-173; Ord. 01-42; Ord. 18-42)

12.6.502: CUSTOM PRODUCTS, REGULAR, ONGOING SYSTEM SERVICES, AND TECHNICAL ASSISTANCE; RATES AND CHARGES:

   A.   A charge shall be collected from persons and non-Utilities City departments for custom products; regular, ongoing system services; and technical assistance furnished. The charge collected shall be for the amount determined by the Chief Executive Officer.

   B.   The computation of the charge shall be based on the resources which the Chief Executive Officer has determined is required to comply with the applicant's request and the Chief Executive Officer's approved resource rates. (Ord. 98-173; Ord. 01-42; Ord. 18-42)

12.6.503: DIGITAL DATA:

   A.   A charge shall be collected from persons for digital data furnished. The charge collected shall be for the amount determined by the Chief Executive Officer. The computation of the charge shall be based on the resources which the Chief Executive Officer has determined is required to comply with the applicants' request and the Chief Executive Officer's approved resource rates.

   B.   A charge may be collected from participants for access to FIMS digital base map, but this charge shall not include an amount for recovering the cost for developing FIMS base map. Non-Utilities City departments shall, however, pay for all computer equipment, computer software, communications and other equipment required: 1) to accommodate their own individual service requirements, and 2) to prevent the service they are provided from degrading overall system performance. 12.6.504: WAIVING OF CHARGES:

For good cause, the Chief Executive Officer may in certain circumstances waive the charges for system products and services. The charges may be reduced or waived when the Chief Executive Officer determines it is in the best interest of the Utilities. (Ord. 98-173; Ord. 01-42; Ord. 18-42)

12.6.505: REVIEW OF RATES:

   A.   The Chief Executive Officer shall be responsible for establishing system rates and changes thereto. Resource rates shall be established for different categories of staff, equipment, communications, computer programs, materials and/or supplies. Copy rates shall be established for copies of standard products.

   B.   Copy rates and resource rates may include amounts for recovering the cost incurred in planning and developing the system; the cost of maintaining and enhancing the system; the cost of servicing the applicant and for administrative overhead.

   C.   On an as needed basis, the Chief Executive Officer shall complete a review of those costs having a bearing on resource rates and on copy rates and make adjustments thereto. (Ord. 98-173; Ord. 01-42; Ord. 18-42)
