It shall be the duty of the officers of the Police Department, or officers as are assigned by the Chief of Police, to enforce all street and traffic regulations of this City and all of the State laws applicable to street and highway traffic in this City.
A. Police: Officers of the Police Department, or special officers as are assigned by the Chief of Police, are authorized to direct all traffic by voice, hand or signal in conformance with State traffic laws and this chapter. However, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers may direct traffic as conditions may require, notwithstanding the provisions of State traffic laws or the provisions of this chapter.
B. Fire Department Members: Members of the Fire Department, when at the scene of a fire, or any emergency to which they are called or respond, or upon leaving or entering a fire station, may direct or assist the police in directing traffic at the scene or in the immediate vicinity.
C. School Crossing Guards:
1. Authorization And Training Responsibilities:
a. Employees or agents of the school districts within the City of Colorado Springs are authorized to direct traffic by voice, hand or signal in conformance with State traffic laws and this chapter, at school crosswalks as established by the school districts, and approved by the City Traffic Engineer and the Chief of Police. School crosswalks established on State highways must also be approved by the State Department of Highways.
b. It shall be the responsibility of the school districts which initiate school crosswalk guard programs to ensure the training of school crosswalk guards. Further, it shall be the responsibility of the school districts which engage in a school crosswalk guard program to ensure that school crosswalk guards are on duty in accord with the appropriate program. The school districts understand that neither the City of Colorado Springs nor the State of Colorado assumes any liability by authorizing the school districts to enter into a school crosswalk guard program.
2. Funding And Contracting:
a. The City may contract annually with any school or school district to establish a pedestrian safety program for school zones.
b. A pedestrian safety program funding fee shall be assessed on all convictions resulting from the issuance of a summons and complaint alleging a municipal traffic violation of this chapter, excepting articles 11 through 16 and 25 of this chapter relating to parking violations, and excepting violations of subsections 10.5.104F, "AVIS Violations" and 10.17.105C5, "AVIS Violations", of this chapter.
c. All proceeds derived from the pedestrian safety program funding fee shall be applied to any expenses incurred as a result of the implementation of a pedestrian safety program for school zones, which program may include a driver education component.
d. Annually upon the publication of a pedestrian safety index by the City Traffic Engineering Department, the Mayor shall determine the amount of the recommended fee. In determining the fee amount, the Mayor shall consider the findings of the pedestrian safety index, the recommendations, if any, of the Student Pedestrian Safety Advisory Committee, and any contract obligations. No person shall wilfully fail or refuse to comply with any lawful order or direction of any police officer or member of the Fire Department at the scene of a fire, who is invested by the law or ordinance with authority to direct, control or regulate traffic. A. Every person riding or leading an animal or driving any animal drawn conveyance upon a street or roadway of this City shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle, except those provisions of this chapter which by their nature can have no application.
B. Persons riding or leading animals on or along any street or highway within this City shall ride or lead the animals on the left side of the street or highway facing approaching traffic. This shall not apply to persons driving herds of animals along a street or highway where the movement is permitted. (1968 Code §6-24-4; Ord. 75-86; Ord. 01-42)
