10.4.101: OBEDIENCE TO STOP SIGN AT RAILROAD CROSSING:
Where stop signs are erected at railroad crossings the driver of any vehicle shall stop within fifty feet (50') but not less than fifteen feet (15') from the nearest rail of the grade crossing and shall proceed only upon exercising due care. (1968 Code §6-4-1; Ord. 75-86; Ord. 01-42)
10.4.102: OBEDIENCE TO RAILROAD SIGNALS:
   A.   Whenever any person driving a vehicle approaches a railroad grade crossing, the driver of the vehicle shall stop within fifty feet (50') but not less than fifteen feet (15') from the nearest rail of the railroad and shall not proceed until the driver can do so safely. The foregoing requirement shall apply when:
      1.   A clearly visible signal device gives warning of the immediate approach of a railroad train;
      2.   A crossing gate is lowered or a human flagman gives or continues to give a signal of the approach or passage of a railroad train;
      3.   A railroad train approaching within approximately one thousand five hundred feet (1,500') of the highway crossing emits a signal audible from the distance, and the railroad train, by reason of its speed or nearness to the crossing, is an immediate hazard;
      4.   An approaching railroad train is plainly visible and is in hazardous proximity to the crossing.
   B.   No person shall drive any vehicle through, around or under any crossing gate or barrier at a railroad grade crossing while the gate or barrier is closed or down for the purpose of preventing the crossing, or is being opened or closed. (1968 Code §6-4-2; Ord. 75-86; Ord. 01-42)
10.4.103: CERTAIN VEHICLES TO STOP AT ALL GRADE CROSSINGS:
   A.   The driver of any motor vehicle designed to carry ten (10) or more passengers, or of any school bus carrying any school child, or of any vehicle carrying explosives or hazardous materials as a cargo or part of a cargo, or of any vehicle designed to carry flammable liquids, whether empty or loaded, before crossing any track or tracks of a railroad, shall stop the vehicle within fifty feet (50') but not less than fifteen feet (15') from the nearest rail of the railroad and while so stopped, shall listen and look in both directions along the track for any approaching train and for signals indicating the approach of a train, except as provided in subsections B through E of this section inclusive, and shall not proceed until the driver can do so safely.
   B.   After stopping as required in this section and upon proceeding when it is safe to do so, the driver of any vehicle described in subsection A of this section shall accelerate so that the vehicle or the driver does not shift gears while crossing the track or tracks.
   C.   No stop need be made at any railroad crossing where a police officer or a traffic-control signal directs traffic to proceed.
   D.   When stopping as required at a railroad crossing, the driver shall keep as far to the right of the roadway as possible and shall not form two (2) lanes of traffic unless the street or roadway is marked for four (4) or more lanes of traffic.
   E.   The stopping requirements set forth in subsections A and B of this section shall not apply where it has been determined by this City or the State that trains are not operating during certain periods or seasons of the year and an official sign carrying the legend "Exempt Crossing" has been erected giving notice when posted that the crossing is exempt from the stopping requirement. 10.4.104: MOVING HEAVY EQUIPMENT AT RAILROAD CROSSING:
   A.   No person shall operate or move any crawler-type tractor, steam shovel, derrick, roller or any equipment or structure having a normal operating speed of ten (10) or less miles per hour or a vertical body or load clearance of less than nine inches (9") above the level surface of a roadway upon or across any tracks at a railroad grade crossing without first complying with this section.
   B.   Notice of any intended crossing shall be given to a representative of the railroad and a reasonable time be given to the railroad to provide proper protection at the crossing.
   C.   Before making any crossing, the person operating or moving any vehicle or equipment shall first stop not less than fifteen feet (15') nor more than fifty feet (50') from the nearest rail of the railroad and while so stopped shall listen and look in both directions along the track for any approaching train and for signals indicating the approach of a train, and shall not proceed until the crossing can be made safely.
   D.   No crossing shall be made when warning is given by automatic signal, crossing gates or a flagman or otherwise of the immediate approach of a railroad train or car.
   E.   Subsection C of this section shall not apply where it has been determined by this City or the State that trains are not operating during certain periods or seasons of the year and an official sign carrying the legend "Exempt Crossing" has been erected giving notice when posted that the crossing is exempt from the stopping requirement. 10.4.105: DRIVING UPON OR ALONG RAILROAD RIGHT OF WAY:
   A.   It shall be unlawful for any person to operate any motor vehicle along or upon any railroad right of way except at the intersections of public streets or highways in the rights of way.
   B.   The provisions of subsection A of this section shall not apply to Federal, State or City motor vehicles, nor shall those provisions apply to railroad motor vehicles or to persons operating motor vehicles upon the rights of way with the permission of the railroad.
