3-1-12: OFFENSES; NUISANCES; PROCEDURES NONEXCLUSIVE:
   A.   It is unlawful for any person to engage in, conduct or carry on any business or occupation within the village of Cloudcroft without first registering the same or obtaining a license therefor, and without first paying the fees in compliance with the provisions of this title.
   B.   It is unlawful for any person to knowingly file an application for issuance or renewal of any business registration or business license, upon which any of the information required by the application has been falsified.
   C.   It is unlawful for any person to engage in, conduct or carry on any business within the village without obtaining any license that may be required for it by the state of New Mexico. This prohibition includes, but is not limited to, engaging in the business of contracting of a type for which the owner is not licensed, even though the owner may be licensed for another type of contracting.
   D.   Any person violating the provisions of this section shall be punished as provided in section 3-1-11 of this chapter.
   E.   No business registration or license issued pursuant to this chapter shall be construed to permit the operation of the business as a nuisance.
   F.   The remedies provided in this section are nonexclusive. If a person engages in business in the village, without obtaining the required registration or license, the village may proceed in any manner authorized by law, including specifically, but not limited to, the procedures set forth in sections 3-38-5 and 3-38-6, New Mexico Statutes Annotated 1978, as the same may be amended or superseded from time to time.
   G.   In addition to other remedies provided in this section, the village may enforce the requirements of sections 3-38-1 through 3-38-6, New Mexico Statutes Annotated 1978, as amended or superseded, by an appropriate action in a court of competent jurisdiction any time up to four (4) years after the violation.    H.   No vending or advertising is allowed on village rights of way or on other village owned property except as specifically authorized elsewhere in this code or by specific act of the village board of trustees. Such authorization is not granted by the mere issuance of a business license or payment of a business registration fee in accordance with this code. (Ord. 311, 9-11-2002)
