(a) Where a check has been deposited with a bid which through inadvertence of the bidder has not been certified, or the amount thereof is insufficient by an amount less than ten percent (10%) of the required amount under the provisions of Section 185.05, the Board of Control, when satisfied that it is in the public interest to do so, may waive such informality or irregularity and award the contract pursuant to such bidding to the lowest responsible bidder notwithstanding such informality or irregularity.
(b) In the event of any such waiver by the Board, the Mayor shall transmit to Council, at the next regular meeting thereafter, a report of such waiver containing the name of each bidder, the amount of each bid, the purpose and amount of the contract awarded and the nature and reason for such waiver.
