Every railroad company to which a permit has been issued to occupy or cross any street by its tracks shall be required to maintain the area of such street so occupied or crossed, including a space one (1) foot beyond each rail or the outer rail in case of more than one (1) track, in a state of repair equal to that maintained upon the street in the vicinity of such tracks. Upon failure to undertake to make any repairs ordered in writing by the Director of Public Service, within ten (10) days after receipt of such notice by any railroad company, the Director shall cause such repairs to be made forthwith at the expense of the railroad company.
