§ 3116.01 Definitions
   The definitions contained in Ohio Environmental Protection Agency (“Ohio EPA”) General Permit Number “OHC000005”, entitled “Authorization for Storm Water Discharges Associated With Construction Activity under the National Pollutant Discharge Elimination System” in effect at the time a permit is applied for under this chapter shall apply to this chapter, except the following definitions shall apply:
   (a)   “Construction activity” for purposes of this chapter, means any clearing, grading, excavating, grubbing, trench dewatering, and/or filling activities that disturb one (1) or more acres of land. The threshold acreage includes the entire area disturbed in the larger common plan of development or sale.
   (b)   “Director” means the Director of Building and Housing or his or her designee.
   (c)   "Long-term inspection and maintenance covenant" means a legally recorded document that acts as a property deed restriction, and that requires the owner to inspect and maintain the post-construction storm water best management practices ("BMPs") and measures in accordance with the post-construction operation plan, which is required as part of the Storm Water Pollution Prevention Plan (SWP3) and OHC000005.
   (d)   "Ohio EPA Permit No. OHC000005" means the Ohio EPA's National Pollutant Discharge Elimination System construction general permit number OHC000005, effective April 23, 2018 and any subsequent versions of that permit issued by the Ohio EPA.
   (e)   "Person" means any individual, partnership, firm, association, joint venture, public or private corporation, trust, estate, commission, board, public or private institution, utility, cooperative, or any other legal entity.
   (f)   "Storm Water Pollution Prevention Plan" (SWP3) means a document prepared in accordance with sound engineering and/or conservation practices by a professional experienced in the design and implementation of standard erosion and sediment controls and storm water management practices addressing all phases of construction and post-construction that meets all the requirements and contains all the information described in Ohio EPA Permit No. OHC000005, Part III, effective April 23, 2018 and any subsequent versions of that permit issued by the Ohio EPA.
