The owners of 51 percent of the property abutting on any public way, or portion thereof, (a) that is unimproved, (b) that was improved by the Work Projects Administration and has not been reconstructed within minimum specifications established by the State of Illinois for construction of streets, or (c) that was originally constructed or improved by a private contractor or developer and does not meet minimum specifications established by the State of Illinois for the construction of streets may petition for the construction of a street on the public way. Such petition shall be filed with the commissioner of transportation of the City of Chicago.
