No bed, crib, playpen or other enclosed device that is intended for use by an infant may be sold, offered for sale or given away without compensation unless such article meets the following standards.
(a) The space between the vertical and horizontal bars or slats, that may create such enclosure, shall be no more than two and three-eighths inches apart.
(b) Such article shall be made out of nontoxic materials that resist peeling and cracking.
