It shall be unlawful for any person to pick or gather up from any public way or public place, any cigar or cigarette butt or stump, or the waste, unused, or unburned portion of any cigar, tobacco, or cigarette, for the purpose or with the intent of bartering, selling, or disposing of the same for use in any form of manufactured tobacco.
It shall be unlawful for any parent, guardian, or person having the legal custody or control of any child under the age of 18 years, to knowingly permit, aid, advise, or encourage any such child to gather or pick up from the public ways or public places any cigar or cigarette butt or stump, or the waste, unused, or unburned portion of any cigar, cigarette, or tobacco.
