(a) As used in this section and Section 2-20-027, "O'Hare Modernization Program" or "O.M.P." means the plan for modernization of Chicago O'Hare International Airport by (1) construction and reconfiguration of runways, taxiways, and facilities for movement and servicing of aircraft; construction of western airport access and related roadways; construction and reconfiguration of roadways, terminals, passenger transportation facilities, parking facilities, and cargo facilities; construction of drainage and stormwater management facilities; and related projects, within the area specified in the definition of "O'Hare Modernization Program" in Section 10 of the O'Hare Modernization Act (620 ILCS 65/10); and (2) provision for air navigation and air safety outside that area in accordance with standards established by the Federal Aviation Administration.
(b) The commissioner of aviation shall have the management and control of all matters and things pertaining to the O'Hare Modernization Program, including its design, construction, operation and maintenance. Nothing in this chapter limits the authority of the commissioner of aviation to exercise powers and perform duties under any other provision of this chapter or Chapter 10-36 of this Code.
(c) The powers of the commissioner of aviation shall include but not be limited to the powers given to the executive director of the O.M.P. in the ordinance providing authorization for execution of agreements for wetlands mitigation site development and maintenance at Chicago O'Hare International Airport, adopted by the city council on June 23, 2004, and appearing in the City Council Journal of Proceedings of such date at pages 26873 through 26876; and the ordinance providing authorization for execution of agreements with various entities for implementation of the O'Hare Modernization Program, adopted by the city council on September 1, 2004, and appearing in the City Council Journal of Proceedings of such date at pages 29893 through 29900.
(d) The commissioner of aviation and the department of aviation shall assume all rights, powers, duties, obligations and responsibilities of the former executive director of O'Hare modernization and the former office of O'Hare modernization, respectively.
(e) In addition to any other authority granted in this chapter or Chapter 10-36 of this Code, the commissioner of aviation is authorized to adopt such rules and regulations as the commissioner may deem expedient for the proper administration of the provisions of this code pertaining to the O.M.P. The rules and regulations adopted shall be printed and made available at the office of the department.
