2-20-027 Additional O.M.P. ancillary agreements.
   (a)   Findings. On September 1, 2004, the City Council of the City of Chicago passed an ordinance appearing on the Journal of Council Proceedings, pp. 29897 – 29900 (the "O.M.P. Ancillary Agreement Ordinance") authorizing the executive director of the O.M.P. to coordinate with, obtain the cooperation of and enter into various agreements (collectively, "O.M.P. Ancillary Agreements") with various local, State and federal governmental entities and agencies, utility companies, railroads and air carriers identified in the O.M.P. Ancillary Agreement Ordinance (collectively, "O.M.P. Ancillary Agreement Parties"). The City Council finds that the physical and operational complexities of the O.M.P. require negotiation, execution and implementation of agreements from time to time with existing airport tenants and licensees not identified in the O.M.P. Ancillary Agreement Ordinance as may be needed from time to time to temporarily or permanently install, relocate, maintain or operate Federal Aviation Administration navigational aids and other airport safety and security infrastructure (collectively, "Additional O.M.P. Ancillary Agreements").
   (b)   The commissioner of aviation or her designees are hereby authorized to negotiate Additional O.M.P. Ancillary Agreements with existing airport tenants and licensees as may be necessary or desirable from time to time to temporarily or permanently install, relocate, maintain or operate Federal Aviation Administration navigational aids and other airport safety and security infrastructure as directed by the Transportation Security Administration. Any obligations payable by the City pursuant to such Additional O.M.P. Ancillary Agreements may only be paid out of legally available funds of the Airport. Such Additional O.M.P. Ancillary Agreements may contain such terms and conditions as are determined by the Commissioner of Aviation to be necessary and desirable, including, without limitation, provisions pursuant to which the City agrees to indemnify or hold harmless any party or parties to such Additional O.M.P. Ancillary Agreements. The commissioner of aviation shall cause to be filed with the City Clerk and with the Chairman of the City Council Committee on Aviation a copy of each Additional O.M.P. Ancillary Agreement executed pursuant to this Ordinance promptly after the execution of such Additional O.M.P. Ancillary Agreement.
   (c)   The commissioner of aviation and other City officials and employees are hereby further authorized and directed to do any and all things necessary to effect the performance of all obligations of the City under this section or to implement Additional O.M.P. Ancillary Agreements that have been executed pursuant to this section and to execute and implement such other related documents as may be necessary or desirable to implement the objectives of this section.
