ARTICLE II. WASTE HAULERS
DIVISION 1. GENERALLY
Any material breach or failure to abide by this chapter by the waste hauler shall be grounds for suspension of the license issued by Eaton County. Failure to abide by this chapter shall constitute a municipal civil infraction. Each day of violation is considered a separate offense.

(A) A waste hauler granted a license by Eaton County and registered by the city may collect from each customer in the city all waste which is placed in a waste receptacle, recyclable receptacle or waste dumpster and dispose of the waste at a disposal site or a handler of recyclable material.
(B) Waste haulers shall offer their customers options for selecting volume based and priced service that provides financial incentives for recycling.

(A) A waste hauler granted a license by Eaton County and registered by the city to pick up residential waste shall develop, implement, maintain and provide a comprehensive weekly curbside recycling program.
(B) All waste haulers who pick up residential waste shall pick up recyclable materials from each residence and, at the hauler's option, haulers shall either pick up recyclable material placed in clear or translucent plastic bags or furnish to each residence separate recycling receptacles, clearly marked as containers for recyclable products.
(C) Recyclable items may be segregated from all other solid waste material at residential units. Recyclable items shall be placed in household recycling receptacles or bags and placed out for collection only on the days designated for collection of recyclable items.
(D) The collection point shall be either at the curb or if no curb at the edge of the city right-of-way directly in front of the residential property or at a place authorized by the Director of Public Works.
(E) A tag system shall be implemented to inform customers when inappropriate items are set out for recycling. All such items shall be tagged with a brief explanation of why the item was not picked up by the waste hauler.

(A) All waste shall be collected by a licensed and registered waste hauler at least 1 time each week and disposed of outside of the limits of the city at a disposal site or recycler. Waste will not be collected on holidays or Sunday. If a collection date falls on a holiday, the very next day may become the collection day for that collection route, and the other collection days may be put forward by one day. Waste haulers must provide adequate notification of their holiday week collection schedule to their customers. Except under unusual circumstances or as necessitated by a holiday, collection days will be Monday through Friday for residential customers and shall include Saturday for commercial and industrial customers.
(B) The holidays, for purposes of this section, shall be New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day. The waste hauler shall observe any or all of such holidays by suspension of collection service on the holiday, but this in no manner relieves the waste hauler of its obligation to provide collection service at least once per week to each customer. All collection days will be on the days from Monday through Friday, unless a holiday falls during the week and requires a collection day to be held on a Saturday.
(C) When waste is removed from the city, it shall be done in a neat and orderly manner so that the waste is not spilled or blown onto the streets or private property. All refuse hauled by the waste hauler shall be so contained, tied or enclosed that leaking, spilling or blowing is prevented.

Collection operations of the waste hauler shall not start before 7:00 a.m. or continue after 5:00 p.m. on the same day. Exceptions to collection hours shall be effected only upon the mutual agreement of the City Manager and the waste hauler in writing or when the waste hauler reasonably determines that an exception is necessary in order to complete collection on an existing collection route due to weather or other circumstances that are beyond the control of the waste hauler. In all cases, such exceptions shall be reported to the office of the City Manager.
