8-6-3: NEW SIDEWALKS TO CONFORM:
All new sidewalks that may be rebuilt, shall be built on and made to conform to the grade which shall be established by the city engineer, and a record of the sidewalk grade when established, shall be kept in a book provided for that purpose, and permanent stone landmarks set below the frost line to keep the grade line as established in a condition to be ascertained for the purpose of public improvements in the city. Any person violating any of the provisions of this section shall be subject to a penalty of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each and every offense. 8-6-4: CITY ENGINEER TO GIVE GRADE:
When the city shall require a new sidewalk to be built and constructed, or shall condemn an old sidewalk and require the construction of a new sidewalk, before the same shall be required to be constructed, the city shall establish the grade, and shall also make the grade ready for the construction of said sidewalk, and put the same in proper condition for the laying of the sidewalk as may be required, which said grading shall be done and prepared by general taxation. It shall be the duty of the city engineer to establish such grade, and the grades herein required to be prepared shall be done by and under the supervision of the superintendent of streets of the city. 8-6-5: RAILROAD TRACKS TO CONFORM:
It shall be the duty of all railroad companies or corporations, or the owners or proprietors of all railroad tracks, whose tracks now or hereafter may enter or pass through the city, or whose tracks are located upon, or may hereafter be located upon, any streets or alleys within the city, to raise or lower their respective tracks to conform to any grade which is or may be established by the city, or any street upon or through which said railroad tracks may run, and where such tracks run lengthwise of any street, to keep the same not to exceed one inch (1") above the surface of such street, and so that such streets may be conveniently crossed at any place on such street. Any railroad or railway company or corporation failing, neglecting or refusing to comply with the provisions of this section, after five (5) days' notice so to do in writing by the superintendent of streets, shall be fined not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each offense; and the recovery of one fine shall be no bar to future prosecution for a like failure or neglect. 8-6-6: BRIDGES, CULVERTS, CROSSINGS TO CONFORM:
All bridges, culverts and street crossings hereafter constructed upon any street within the city shall be so constructed as to conform, as nearly as possible, to the established grade of the street upon which said bridges, culverts or crossings shall be located. (R.O. 1959, Ch. 22, Sec. 6)
